Important Computer Hard disk missing in Adarsh Housing
Society Scam Case CBI told to Court and Arrested 3 officers

In Adarsh Society Scam building before this 2 files were gone missing and now 3rd time the hard disk related to Adarsh Housing Society is missing.



The Central Bureau of Investigation (CBI) has informed the special CBI court that one out of the 10 hard disks from the Urban Development department - pertaining to the case has gone missing.

Today CBI informed to Court that the important Hard disk related with Adarsh Housing Society is missing and CBI demanded Police Custody of 3 Persons and Court granted the application demand of CBI.

After that in relation with missing hard disk CBI arrested 3 officers.
Following are the names of Officers who were arrested by CBI in connection with Missing Hard disk.

Before this 2 files were also missing now Hard disk is missing.

Last September Adarsh Scam came into public domain, public knowledge after that some important files regarding the Adarsh building were found to have been missing from the office of State Urban Development Department that is UDD


May 5 –
While hearing a PIL regarding the scam this afternoon, Bombay High Court had questioned CBI for neglecting "the missing files case", directing the agency to focus on it too.

After this CBI arrested three state government officials in connection with the Adarsh Housing Society missing files case.

Following are the names of State Urban Development Department that is UDD officers who were arrested by the CBI in connection with Adarsh Missing file

CBI officers said that the three accused were the last ones to have dealt with the missing file. During the questioning, they did not give clear answers, so they were arrested,"

Found that in 2009 Chavan borrowed Rest 65 lakh from IPS officer Sanjay Barve
To pay for the Adarsh flat allotted to his mother-in-law Bhagwati Sharma.

To return this favor CBI found that Ex CM Ashok Chavan helped IPS officer Sanjay Barves father get an apartment in the building.

Barve Paid Rs.65 Lakh by way of Cheque but CBI suspects that its only for name sake, it was bribe or money was launder and in exchange Sanjay Barve got flat in Adarsh Scam building.

The Army submitted its Court of Inquiry report on the Adarsh Cooperative Housing Society scam on Wednesday to the Defense Ministry.

The CoI was ordered by Army's Pune-based Southern Command to investigate the role of Hooda and various other officers.

Once again report clearly mentions that the land on which Adarsh society stands is Defense land. And that a no-objection certificate was issued to private developers in violation of rules.

Former army chiefs Gen Deepak Kapoor and N C Vij, apart from former navy chief Admiral Madhavendra Singh had flats allotted in their names in the housing society.

The preliminary findings of the ministry's probe brought out "criminal conspiracy" at the local level in army and defense estates to give up the land, which was in army's possession till 1999-2000, in favor of the housing society.

Adarsh scam inquiry commission working without Salary

Two Months back Government of Maharashtra set up the two-member inquiry commission
To go into Adarsh scam, has started its work and issued notices to all the members of the housing society and also received replies.
The commission is working without salary.
the commission has been asked to go into alleged irregularities in allotment of plot and grant of additional floor space index (FSI) to Adarsh Housing Society.




The notification for the commission came on January 8. Around 20 persons including the two Commission members were appointed in the commission. But they are yet to receive their salaries," the officials said.

The commission was expected to submit its report within three months from January 8. However, all the resources, including office space, were given only in February.

The state government, which ordered formation of the two-member Commission headed by retired High Court Justice J A Patil with former chief secretary P Subramanian as its member in January, recently got to know that the panel has been sanctioned some funds but they were in for a rude shock when informed that some formalities were yet to be completed for withdrawal of cash, state government officials said.

"The commission has already sent out summons to all the 103 members of the Adarsh society and has received affidavits from over 60 members.

All the commission members are working everyday despite not having received the salary," they said.

Out of the 103 summons sent out, over 40 of them returned as many members had changed their residences. Another set of summons was sent out a week later and the reply affidavits are awaited, the officials said.

The commission, which is likely to seek an extension to submit its report, would look into issues including whether the land was reserved for kin of Kargil war martyrs and violation of Coastal Regulation Zones.

The commission will work like a court, where a prosecution lawyer would be appointed to argue the case, while the respondents may either appear in person, or appoint a lawyer to defend themselves.

The commission’s probe would run parallel to the inquiry by the CBI, which has registered a case against 13 persons, including former chief minister Ashok Chavan, for criminal conspiracy, fraud and misuse of official powers.

The society was built on a prime piece of land, allegedly belonging to the defence ministry.

It was originally meant to be a six-storey structure, but later it got permission - against rules - to build 31 floors.

Maharashtra government asked to Ramanand Tiwari and Subhas Lalla to resign over their involvement in the Adarsh Society scam.

Tiwari was urban development secretary when the Adarsh file was being processed
Tiwari's son, Omkar is member in Adarsh society



Subhas Lalla was secretary to the chief minister.
Lalla's mother Susheela Shaligram and daughter Sumeela Sethi.are members in Adarsh society.

What would have happen if both have resigned after the demand from government?
The duo's resignation has to be forwarded to the state governor for his acceptance.

But both Ramanand Tiwari and Subhas Lalla has denied and said that they will not resign from their post, directly challenging the government of Maharashtra.

Information commissioner Ramanand Tiwari and human rights commission member Subhash Lalla both refused to quit, saying they were not involved in the Adarsh Housing Society scam.

Now government has to start the process of dismissal against them.

To remove Ramanand Tiwari the state government will have to knock on the doors of Raj Bhavan

To remove Subhash Lalla state government will have to approach the President of India.

Both the duo know that Government has done nothing in 2G spectrum scam so they must have become fearless and also our Indian government moves so slow that they will retire from their post but our government will not give their decision of sacking them , firing them from their job.

If congress government want action on corrupt babus from heart then state and central government should sack and fire both of them by working hard in a week time.

But do you think our government can work for the India?
Will they terminate the services of babus?

We need to amend our Indian laws and remove all type of protections these babus and
politicians enjoy.

Former IAS officer Subhash Lalla, whose mother and daughter own flats in the scam-hit Adarsh Housing Society in south Mumbai resigned as a member of Maharashtra State Human Rights Commission.

Subhash Lalla met Governor K Sankaranarayanan at Raj Bhavan this morning and submitted his resignation.

"The Governor has accepted Subhash Lalla's resignation

Justice equals to Life Imprisonment for corruption.

Government officers, babus know the law and under stand the law this is reason they use the loopholes and make the illegal matters look legal matter.

The again problem is our corruption law is useless and tooth less and regarding government babus transfers the laws are useless.

We need amendments in all the laws.

They say we are going to become super power, and do not know who is the owner of land; they need CBI inquiry to find out who is the owner of land.

Politicians resign but they indirectly keep enjoying all the benefits as they are replaced by their friends.

If I am king, as punishment I resign and make my son or wife or brother a new king, what is use of such punishment.

When person goes to jail that is punishment.
When person pays 1000 times more fine then that is called as punishment.

Also we need to punish government officers who ignored their right duty to serve to India.

The Guilty, still not proven in court of law Government officers in Adarsh Housing Society Scam -

According to Y.P Singh,
Ramanand Tiwari,
who held the lucrative post of Principal Secretary for Urban Development for over six years (2002-2008), violates the service norm that does not allow an individual to hold a post for more than three years.
Tiwari was instrumental in transferring the FSI (Floor Space Index) from the adjacent BEST plot to Adarsh Society, allowing them to construct 12 additional floors.

Subhash Lalla:
As Principal Secretary to then CM, instead of guiding the CM to take the right decision, he appeared to be pushing for the additional FSI from the BEST plot through the CM's office. There were also references by BEST General Manager S S Kshatriya on this matter in a letter addressed to Lalla clearly proves that he was officially handling the Adarsh files.

SS Kshatriya:
As then General Manager of BEST, it was his duty under the BMC Act, to protect the interest of BEST land. If there had to be any relinquishment of interest of the BEST land, it required the approval of the BMC. But instead he tendered a shady No Objection Certificate (NOC) on his own in 2005, favoring Adarsh Society.

"The govt asked for comment, so the factual position was communicated and in no way was that an NOC or change in reservation, which was subsequently done at the government level," said S S Kshatriya, who was then the GM of BEST.

Idzes Kundan:
Former Mumbai Collector (Flat in her name)
In 2009, Kundan wrote to the Revenue Minister recommending her own name in the flat allotment process of Adarsh Society, after they had sent a letter to the minister seeking approval for the inclusion of three fresh names into the Society.
Incidentally, she also recommended the name of present Additional Chief Secretary (Home), Chandra Iyengar, subject to MMRDA's clearance of the building's FSI.

SV Joshi:
Principal Secretary, State Urban Development Department
Joshi wrote a letter on August 19, 1999 to the Environment Ministry claiming that members of Adarsh Society were defense officers who deserved special consideration as they had dedicated their life to the service of the motherland.
The letter also pointed out that some Adarsh members were still fighting in Kargil and surrounding areas. Therefore, Joshi requested for an NOC from the Environment Ministry as a special case.

PV Deshmukh:
Former Deputy Secretary, Urban Development (Flat in his name)
In a letter to the BMC Chief Engineer, Deshmukh claimed that Adarsh had received a NOC from the Union Ministry of Environment and Forests (MoEF).
But the MoEF clarified last week that no such NOC had been issued.

Tried to wash hands in dirty Ganga but saved as more powerful came in their ways.


Chandra Iyengar, State Additional Chief Secretary (Home):
She had applied for a flat in Adarsh but did not find her name in the final list.
Her name was recommended twice by District Collector Idzes Kundan.

Indian Army has ordered a Court of Inquiry into the Adarsh Cooperative Housing Society scam and the alleged role of senior serving and retired officers in it, including Major General RK Hooda.
Major General RK Hooda is also the member of Adarsh Cooperative Housing Society

The Army's Pune-based Southern Command headquarters ordered the probe

The three-member Court of Inquiry would determine and find out

•How Major General RK Hooda hid he facts from his superiors

•How and on what basis did he secure his membership in the Adarsh Society

•how senior Army officers issued a No-Objection Certificate to Adarsh society

The Presiding Officer the Court of Inquiry is Major General Rawat.

CBI will question all the 103 members of the Adarsh housing society
The Central Bureau of Investigation (CBI) is likely to question former Maharashtra Chief Minister Ashok Chavan in connection with the Adarsh Housing Society scam.

The CBI's preliminary inquiry found that the land belongs to the defence.



The CBI, which had on November 15 registered a Preliminary Enquiry (PE) in the scam

CBI officials on Nov 16 met Maharashtra chief secretary JP Dange and asked him to submit all essential documents and papers regarding the housing scam as soon as possible.

Still CBI has not filed the First Information Report in this scam.
This will happen only after filing of FIR.

In Next 1 or 2 weeks it is expected that CBI will file the FIR regarding this scam.

The FIR would be against personnel from the defence and state government (Mumbai Metropolitan Region Development Authority (MMRDA) and The Brihanmumbai Municipal Corporation (BMC).

As per media reports CBI would examine whether Ashok Chavan signed a letter recommending 40 per cent allotment of flats to civilians in the Adarsh Housing Society. When he was Revenue Minister.
Also, if the occupancy certificate (OC) was issued to the society when he was the Chief Minister.

The CBI would also question Chavan on the flats owned in the society by his mother- in-law, sister- in- law and one more relative, on whether he knew about the purchase deals and if he was aware of the correspondence they had with the society.

These members would be questioned on the income tax details submitted by them while purchasing flats, on when and how they bought them and on their correspondence with the society and departments of the state government

Adarsh Society scam -
4 important documents related with Adarsh Society scam got stolen and A case of theft has been registered and an investigation into the theft is on.
These files were in possession of Urban Development Department in Mumbai.

Central Bureau of Investigation found page numbers 15, 27, 99 and 279 of the file missing and notified the Urban Development Department.

The CBI had received a copy of the file for their probe into the controversy-hit society.

The Urban Development Department then lodged complaint of papers being stolen.

Environment Minister Jairam Ramesh said that
"We have received a bunch of papers from the state environment department and the Coastal Regulation Zone department.
Based on the evidence that we have got so far, no clearance was given for the Adarsh Society buildings.


We are awaiting papers from the state urban development department. Decision will be taken in two-three days,"
State urban development department is not authorized to give clearance. "Let's see what they say in their reply," the Minister said.

Environment Minister Jairam Ramesh said that in next 2 or 3 days the action will be taken on Adarsh Housing Society.

It is expected that the 25 illegal floors of Adarsh Housing Society will be demolished.

I hope that Environment Minister Jairam Ramesh will take strict action on Adarsh Housing Society and will see that the 25 illegal floors of Adarsh Housing Society will be demolished as fast as possible, as early as possible.

Maharashtra Chief Minister Ashok Chavan has been asked to tender his resignation to Governor K Sankaranarayanan pending an inquiry into the Adarsh Cooperative Housing Society scam in Mumbai.

Following Maharashtra Chief Minister Ashok Chavan's submission of resignation to the Governor today



Mr Ashok Chavan met the Governor at Raj Bhavan this morning and tendered his resignation as Chief Minister of Maharashtra along with that of all the members of his Council of Ministers.

The Governor of Maharashtra K Sankaranarayanan accepted the resignation of Chief Minister Ashok Chavan and asked him and his Council of Ministers to continue in their offices till alternate arrangements are made.


Now question is who will be new Chief Minister of Maharashtra ?

2- Maharashtra cabinet minister Harshvardhan Patil

3- MP Balasaheb Vikhe Patil he is 80 years old so he should not become CM.

Following are the honorable politicians of India who recommended flats in an Adarsh society in an adarsh way.


1. - Former Chief Minister Vilasrao Deshmukh: He recommended three flats - those of Uttam Ghakare, Kiran Bhadange and Amol Karbhari when he was the Chief Minister of Maharashtra



2.- Former Chief Minister and now the Revenue Minister, Narayan Rane (CM in 1999): Rane gave initial permission to Adarsh in 1999. He recommended two people - Girish Mehta and Rupali Rao Rane.


3.- Former Chief Minister Sushil Kumar Shinde: He was the chief minister in 2004 and gave final approval to Adarsh in that year. He recommended one person - Major Khankoje

4.- Ashok Chavan: Recommended his mother-in-law, (Bhagwati Manohari Lal Sharma) sister-in-law (Seema Vinod Sharma and brother-in-law (Jagdish Ambika Prasad Sharma).


5.- Patangrao Kadam: Presently the Forest Minister of Maharashra, he had recommended Balasahib Sawant for a flat.

6.- Shivaji Rao Nilangekar: He was the Revenue Minister and cleared the allotment of Adarsh on the 9th of July 2004. He recommended Sampat Khidse and Arun Dawale.


7.- Ajit Pawar, Water Resources Minister, NCP leader and Sharad Pawar's nephew: He recommended Krishna Bhegde and Shivaji Rao Kadhe.

8. - Anil Deshmukh: Minister for Food and Civil Supplies, he recommended Mukund Rao Manikar


9.- R R Patil: Presently the Maharashtra home minister, he recommended Chandrashekhar Gaekwad.

10.- Rural Development Minister Jayant Patil (Relative: Aditya Patil)



11.Nearly every General Officer commanding the Mumbai area from September 2000 to July 2010 have all been given apartments in the controversial building. These include Major General VS Yadav, Major General TK Kaul, Major General Tejinder Singh and Major General RK Hooda.


12.The documents available with CNN-IBN show that membership approval was also granted to serving officers Major General RK Hooda and Lieutenant General Tejinder Singh.

"If a law has been violated, I think the law must be implemented very forcefully.
I don't think there is any case for regularising any illegal building that may have been built. I am very clear, there is a law, and there is CRZ-91 (Coastal Regulation Zone-91). We are modifying CRZ-91 but till that modification comes into being it is CRZ-91," Union Environment Minister Jairam Ramesh had told CNN-IBN.

The Maharashtra Coastal Zone Management Authority had already concluded that the 31-storey Adarsh society in Colaba had violated coastal regulatory norms and was illegal.

The Adarsh society got only permission for 6 floors and 25 other floors are illegal.
They will demolish after the CBI inquiry.

But as per my opinion, they may be illegal, but as we have wrong policies in India, these 25 floors will be made legal by government as a special case and 1 or 2 floors will be removed.

And our Indian courts should need to become more strict and should think legally and not emotionally and should order that the building should be demolished. Court should reject the application or should not give order to stop the demolition of illegal building.

What ever may happen these illegal 25 floors should be demolished by the government to show that for wrongful act, there is punishment in India.

Rishi Raj Singh, Joint Director of CBI said that CBI has asked for three records from the adarsh society.

The CBI proposes to probe into the declarations and affidavits filed by the members. "Its line of thinking is: can a member whose monthly income is between Rs 25,000 and Rs 75,000 afford a flat sold at between Rs 80 lakh and Rs 1 crore?" said the official. "Of the 103-odd members, the monthly income of over 45 members is between Rs 25,000 and 75,000. The CBI will probe into the source of funds of all such members.

The sources said the Army had been in "de facto" possession of the prime 6,490-sq mt plot of land for over 60 years before the Adarsh Society highrise came up there in 2003.


The highrise is built on 6,450 sq metres within the Colaba naval area and the
land was cleared to built the society on the condition of housing war veterans but now has 104 members including senior army commanders, a former environment minister, legislators and state bureaucrats, top army officers and Navy officers.

A controversy has erupted over how the Adarsh society in upscale Colaba, originally meant to be a six-storey structure to house Kargil war heroes and widows, got converted into a 100-metre-tall building 31-storey building


A defence ministry probe has "prima facie" found a "criminal conspiracy" in scam-hit Adarsh Housing Society project in Mumbai in which some relatives of Maharashtra chief minister Ashok Chavan being beneficiaries has emerged.

The WNC objected to the construction allegedly as it also violates the stringent Mumbai Coastal Regulation Zone (CRZ) norms.

Under the Works of Defence Act, 1903, any development, private or public, falling within 1,000 metres of any defence establishment, must get a no objection certificate from the defence ministry.

In a statement issued by retired brigadier M.M. Wanchu, president of the society, said: “The fact is that no defence land has been grabbed, not even an inch has been encroached by Adarsh Society.”


Each of the 103 members of adarsh society will get 90% discount and will pay just 10% of amount. And in future they will sell these flats with full profits .

"This property is in the same line as Taj President at Cuffe Parade and opposite the Ambanis' Seawind building, where residential prices are over Rs 60,000 per square foot. An average two- to three-bedroom-hall-kitchen (BKH) apartment could cost between Rs 6 crore and Rs 8.5 crore in this area," said a leading real estate consultant.

But these members will just pay Rs 60 lakh to Rs 85 lakh for their apartments in the sea-facing skyscraper.
Original and real cost of the each flat is more than Rs.8 Crore.

According to former Congress MLC and one of the leading members of the society, Kanhaiyalal Gidwani, the flats in Adarsh measure between 625 square feet and 1,000 square feet (carpet area) in size. "On each floor, there are four apartments — three are of 2 BHK and one of 3 BHK," Gidwani told TOI on Wednesday.
The politician and his sons own three flats in the building.
The members were asked to pay the amounts in installments over the past five years

The flats, including the land, cost the society and its members Rs 26 crore. The market value is anywhere between Rs 500 to Rs 800 crore


Former Army chiefs Generals Deepak Kapoor and N C Vij and former Navy chief Admiral Madhavendra Singh and Vice-Chief Gen Shantnu Choudhary also got the flats in this society.
Former chief secretary D K Sankaran's son, Sanjoy, is among the allottees.
The society sent out the names of the 103 flat owners in its press release clarifying its position, issued on October 26 and it also includes the names of former Union Minister for Environment Suresh Prabhu, NCP MLC Jitendra Avhad, Congress leader Kanhaiyalal Gidwani and his two sons, a close aide of a senior Maharashtra Minister, the children of some bureaucrats, serving bureaucrats, Seema Vyas and Idzes Kundan, and an individual by the name of S.B. Chavan and the name of Maharashtra Chief Minister Ashok Chavan's late mother- in- law Bhagwati Manoharlal Sharma. Seema Sharma and Madanlal Sharma.
Bhagwati Manoharlal Sharma, 77, passed away at 'Varsha', the Chief Minister's official residence in July.

Maharashtra Chief Minister Ashok Chavan has denied that the Adarsh housing society land was meant for Kargil martyrs. For the families of those who died in the Kargil war it’s yet another betrayal.

As per CNN IBN this adarsh society land real estate address in Mumbai was supposed to be for the families of those brave jawans who lost their lives protecting our nation during the Kargil war.

Chief Minister Ashok Chavan said that land belongs to the State Government, and it was not reserved for Kargil widows or war heroes.
"The land belongs to the state government, based on the Collector's records. Revenue department land granted to the Society as per GR of 9.7.1999. This land falls outside defense boundary. It was not reserved for war veterans or Kargil heroes," said Chavan.

Defence officials say that if the allottees of the 31-storey complex move into the apartments adjoining Pethe Marg at Colaba, it would be a huge security hazard and even a possible soft target for terrorists.
While the engineering transport facility is located around 27 metres from the adarsh society building wall, the two army and navy depots are just 100 metres from the building.

Surprisingly, even the defence establishment till recently has been denying the risk. "In response to the RTI query filed by Yogacharaya Anandji in March 2010, their office said there is no security risk because it falls outside the defence area,"
Anandji who first blew the whistle on the scam. alleges that the fact that many defence officers are also involved in the scam must have influenced the RTI response.

The Central Bureau of Investigation (CBI) is already investigating how the prime land in Mumbai which was marked for Kargil was widows and veterans was given to VIPs instead. The Union Environment Ministry has also raised a red flag saying they did not give the society any clearance.

Former army chiefs, politicians and bureaucrats have all been allotted flats here for a fraction of the market rate that is just 1 /3 rate.

The Ministry of Environment and Forests (MoEF) formally stated that it has not given any clearance to the controversial Adarsh Housing Cooperative Society in Mumbai's Colaba, which falls in the Coastal Regulation Zone (CRZ) limits.

CNN IBN got the letter which shows that three of 104 allottees are chief minister Chavan's relatives. The society also agreed to allocate 40 per cent of the flats to non-defense personnel.
“My family members have given up their society membership today,” said Chavan.
This came after CNN-IBN exposed the housing scam.

Chavan also issued a clearance letter to Adarsh Housing Cooperative Society when he was revenue minister.
The letter said that Adarsh Housing Cooperative Society should be cleared and flats in the society should be alloted in open catagory.

Presently, there are 103 members in the society, of whom 37 belong to the defence (forces).
All the plans were approved by the BrihanMumbai Municipal Corporation (BMC)”, he said, putting the blame at the door of the civic body governed by the opposition Shiv Sena-Bharatiya Janata Party combine.

Maharashtra Chief Minister Ashok Chavan has offered to resign. Chavan said this after his meeting with Congress party chief Sonia Gandhi and Defense Minister AK Antony.

After the meeting, while speaking to the media, Ashok Chavan said, “I have offered to resign. I have given my resignation letter to Sonia Gandhi.
I have given all the details to party high command.
I have told her to see and it is up to her now. Investigations are on.
CBI will investigate the matter. After the investigation it will be clear about the land ownership.”

Senior Congress leader Janardan Dwivedi said that a two-member Congress committee including AK Antony and Finance Minister of India Pranab Mukherjee will review the Adarsh Society scam.
The two-member Congress committee is likely to submit its report by Sunday. The final call will be taken at the AICC meeting on November 2.

the Defence Ministry has now admitted that the land belonged to the Army as of May 2010. The admission comes in response to an RTI application filed on the matter.

Who will take over from chief minister Ashok Chavan? Who will be next chief minister of Maharashtra ?
51-year-old Chavan, son of late Union Home Minister and former Chief Minister S B Chavan, became chief minister on December 8, 2008 after Vilasrao Deshmukh made his way out in the wake of 26/11 terror attack in Mumbai.

it would be difficult to select a new chief minister. Vilasrao Deshmukh and Sushil Kumar Shinde both are involved in the Adarsh Housing Society scam.

This is good opportunity for Mr.Narayan Rane to fulfill his dream of becoming Chief Minister of Maharashtra but media says he also got the flats in this society, which he has refused and still it is not proven.
Minister of State for Science and Technology and the Prime Minister's Office, Prithviraj Chavan, is one of the frontrunners for replacing Ashok Chavan at Mantralaya.

Vilasrao Deshmukh as the Chief Minister gave initial permissions to Adarsh society, while Sushil Kumar Shinde as Chief Minister gave final sanction to the project.
