CBI registered new FIR against Premier Brands Private Ltd and Compact Disc India Ltd
and six commonwealth OC members
The Central Bureau of Investigation (CBI) has filed another first information report (FIR) in the alleged multi-crore Commonwealth Games overlays scam.
CBI spokesperson Dharini Mishra said that ‘The FIR was registered in connection with merchandising and retailing for sports wear May 3.
Six Commonwealth Games organizing committee members and two firms were named in the FIR.
Following are the names of accused OC members and two firms who are named in this corruption case.
1. V.K. Verma
2. Surjeet Lal
3. K.V.K Reddy
4. M. Jayachandran
5. Ram Mohan
6. Sangeeta Welingkar
7. Premier Brands Private Ltd. (PBPL)
8. its parent company Compact Disc India Ltd [CDIL ]
The official said that Commonwealth Games Organising Committee extended undue favours to appoint PBPL as the master licensee for merchandising, online and retail, for the Games.
The committee had fixed a minimum royalty of Rs.7.05 crore. The CBI alleged that after scrapping the earlier bid on flimsy grounds, the evaluation committee dishonestly considered PBPL on the basis of the goodwill of its parent company -- Compact Disc India Ltd -- and gave the company master license for merchandising on an offer of Rs.5.2 crore.
'PBPL submitted two cheques amounting to Rs.3.52 crore but they bounced. The committee did not receive any amount from PBPL,' said the official.
The official also said that PBPL used the CWG brand and earned a huge profit, but did not pay anything to the organizing committee. The accused officials caused huge pecuniary advantage PBPL and loss to the government exchequer.
The official said that the CBI also conducted raids at 10 places at five cites -- Mumbai, Chandigarh, Delhi, Gurgaon and Panchkula.
A total of 12 FIRs have been filed for financial irregularities in organizing the mega event in the capital in October 2010.

Who is Jarnail Singh?
Jarnail Singh is the Prime Minister's appointee Jarnail Singh to the Sports Ministry.
He is the CEO of the Commonwealth Games Organizing Committee.
But CNN IBN got the letters which show that Prime Minister Manmohan Singh's representative on the Commonwealth Games Organizing Committee, Jarnail Singh, knew and approved of the time scoring contract.
The letter shows Mike Hooper and Michael Fennell agreeing with the choice of Swiss Timing for the time scoring deal.
Jarnail Singh in letter said that "Selection of Swiss Timing was done by putting every stage through the highest level of scrutiny not only by the Organizing Committee Finance Committee which has Sanjeev Mittal, Joint Secretary, Rahul Bhatnagar from the Ministry of Sports but also by the empowered finance sub-committee set up by the government, which is chaired by Secretary, Urban Development,"
He further said that "The deal was approved by senior IAS officers in the Commonwealth Games Organising Committee. The deal was also approved by the finance sub-committee set up by the Government. The Organising Committee even managed to get a discount of Rs 26.35 crore from Swiss Timing in the deal,"
Now the question arises is that why Only Suresh Kalmadi was arrested in time scoring contract and not others who helped directly or indirectly to Suresh Kalmadi in this contract.

Suresh Kalmadi and eight others have been chargesheeted by the Central Bureau of Investigation (CBI) in Time Scoring and Results scam.
In the 50-page chargesheet two companies, AKR Constructions and Swiss Timing Omega, have also been named.
They have been charged under Indian Penal Code sections
120(b) (criminal conspiracy),
420 (cheating)
And Section 13 of Prevention of Corruption Act (for giving bribe).
An overall loss of Rs 90 crore was incurred to India and Indian citizens due to awarding the contract to Swiss Timing.

The Congress MP Suresh Kalmadi has been accused of awarding illegal contracts to a Swiss firm for Timing-Scoring-Result (TSR) system for the Games causing a loss of Rs 95 Crore to the exchequer that is loss of Rs.95 Crore to Indian Citizens.
"The price paid to the Swiss firm was more than thrice the amount of Rs 46 crore sought by the only other bidder, MSL of Spain."
CBI spokesperson Dharini Mishra said that "It was Kalmadi's role in his then official capacity as chief of the OC's executive board that led to his arrest.
"Investigation has revealed that the OC committee for short-listing prospective bidders for TSR was constituted by selecting handpicked officials who favored the Swiss company while members of the tenders-evaluation committee were coerced and threatened to disqualify other bidders,"
Manoj Sharma a lawyer from Gwalior tried to hit Suresh Kalmadi with a slipper. But he missed and was overpowered by security personnel present at the Patiala House Court complex.
In 2007 he tried to kill a sub-divisional magistrate with a dagger and was jailed for three years.
Manoj Sharma told the Mid Day that I am a messenger of God, and I am here to punish corrupt people
Manoj Sharma said that he has read much about Utsav Sharma, who attacked Rajesh Talwar and SPS Rathore, and is sympathetic towards him. "He is also a crusader like me. He is punishing the guilty of society and I will punish the most corrupt ministers
Manoj said that three years ago he had contested the Lok Sabha elections independently. "I got around 2500 votes and will again contest the election the next time

Today CBI arrested Suresh Kalmadi in scam related to Baton Relay.
In September 2009 Common wealth Games started in London with The Queen's Baton Relay
A London-based firm named AM Films was hired by Mr. Suresh Kalmadi to provide taxis, portable toilets and massive public TV screens for the ceremony.
He sanctioned transfers of huge amounts of cash to AM Film and its owner, Ashish Patel, even though there was no signed contract.
It’s reported that 2 Member CBI team went to London and they met with the Ashish Patel and is encouraging him to turn approver.
The financial track record of Mr Patel proved to be dubious.
It has also discovered that three other bids made by other UK firms for the Queen's Baton Relay function were forged to give contract to this firm.
In past OC members told that three other bids for Queen's Baton Relay were not competitive enough thus the Contract was given to the AM Films.
The bids attributed to three London-based companies - have turned out to be forged.
The three firms, all based in London - SD Displace, 3 Dots Vision and Movie Tech
But all the three companies said that OC never contacted them and they have never never bid for the baton relay contract.
According to media reports the CBI has got the video recordings of Organising committee (OC) meet in the capital where Kalamdi and his associate, VK Verma announced the awarding of time scoring equipment contract to Swiss timing.
The CBI has suspected Swiss timing's India representative, Gem International, of facilitating the kickbacks to Kalmadi.
Suresh Kalmadi has been arrested under Sections 120 B and 420 (criminal conspiracy and cheating) of the Indian Penal Code in the Commonwealth Games Time Scoring Equipment scam.
Still CBI has not confirmed this news waiting for confirmation but Media has said that CBI has arrested Suresh Kalmadi.
The Lawyer of Suresh Kalmadi Hitesh Jain said that he is not aware of the arrest.

Now it is expected that Kalmadi will be sacked, fired, removed from Indian Olympic Association as he is President.

The raids were carried out at 20 places in Delhi and the National Capital Region.
The CBI officers searched or raided following places

2.
CPWD offices at Major Dhyanchand National Stadium where Kala and Ram work
3.
Jawaharlal Nehru stadium where offices of Chand and Gaur are located

5.
The residence of official Rajiv Sharma at Greater Kailash
6.
The office of company at Greater Kailash

searched residences of all the accused officials spread across Mayur Vihar, Sarojini Nagar, Munirka, Sahyog Vihar, Gazipur and Mehrauli

The Shunglu Committee was formed by the prime minister immediately after the commonwealth games to investigate corruption
The Shunglu Committee has submitted its third report dealing with corruption in civic agencies.
Third Report of the Shunglu committee has blamed the Delhi government and its agencies for several delays in key projects.
The Shunglu Panel, Committee found that loss of Rs.900 Crore India Suffered because of
Delays in construction of bridges, flyovers, roads and all other civic infrastructure work.
Rs 159 crore was wasted only for putting up street lights and signages.
Shunglu found that its tenders were manipulated by bidders in collusion with civic agencies.
Civic Agencies like PWD, MCD and NDMC have been blamed for wasting public money worth Rs 700 crore
Shunglu panel has also asked for action against top Brass of MCD, DDA, PWD and Delhi government for all acts of omission and commission.
The Shunglu panel indicted Lt Gov Tejendra Khanna, Delhi chief minister Sheila Dikshit and a host of senior bureaucrats for cost overruns, favours to select contractors, exaggerated estimates and a staggering waste of public money.
Regarding Lt Gov Tejendra Khanna Shunglu Panel said
"The responsibility for the various acts of omission and commission which brought 'undue gains' to Emaar MGF primarily lies with LG, Shri Tejendra Khanna, ex-officio chairman of DDA (and other DDA officers)."
The Shunglu panel pointed to the Chief Minister Sheila Dikshits involvement in street lighting contract where three firms bid without inviting tenders with the deal going to a German firm. "Unusual interest was displayed by her.
Imported luminaries were approved by her and competition restricted," the report said.
Shunglu Committee said the imported street bulbs were three times as expensive as domestic ones and caused a loss of Rs 46 crore, not including other agencies like MCD and NDMC.
The Delhi government's signage project was also flawed as paint was already peeling off five months after the Games. "About 50% of contract value or Rs 36 crore appears to be wasteful expenditure designed to provide undue benefit to the manufacturer and contractors," said the Shunglu report. Here, too, it mentioned the CM's approvals.
On undue profits to contractors, the panel noted these amounted to
Rs 52 crore in the Barapullah elevated road,
Rs 47 crore in the Ring Road bypass,
Rs 16 crore in streetscaping,
Rs 63 for street lighting,
Rs 46 crore for signages
And Rs 28 crore in the Rajaram Kohli project.
The report also noted how expenses of Games-related facilities at the trade fair or ITPO were revised from Rs 28.02 crore to Rs 75.77 crore.

Rs 159 crore was wasted only for putting up street lights and signages.

Shunglu panel has also asked for action against top Brass of MCD, DDA, PWD and Delhi government for all acts of omission and commission.
The Shunglu panel indicted Lt Gov Tejendra Khanna, Delhi chief minister Sheila Dikshit and a host of senior bureaucrats for cost overruns, favours to select contractors, exaggerated estimates and a staggering waste of public money.
Regarding Lt Gov Tejendra Khanna Shunglu Panel said
"The responsibility for the various acts of omission and commission which brought 'undue gains' to Emaar MGF primarily lies with LG, Shri Tejendra Khanna, ex-officio chairman of DDA (and other DDA officers)."
The Shunglu panel pointed to the Chief Minister Sheila Dikshits involvement in street lighting contract where three firms bid without inviting tenders with the deal going to a German firm. "Unusual interest was displayed by her.
Imported luminaries were approved by her and competition restricted," the report said.
Shunglu Committee said the imported street bulbs were three times as expensive as domestic ones and caused a loss of Rs 46 crore, not including other agencies like MCD and NDMC.
The Delhi government's signage project was also flawed as paint was already peeling off five months after the Games. "About 50% of contract value or Rs 36 crore appears to be wasteful expenditure designed to provide undue benefit to the manufacturer and contractors," said the Shunglu report. Here, too, it mentioned the CM's approvals.
On undue profits to contractors, the panel noted these amounted to
Rs 52 crore in the Barapullah elevated road,
Rs 47 crore in the Ring Road bypass,
Rs 16 crore in streetscaping,
Rs 63 for street lighting,
Rs 46 crore for signages
And Rs 28 crore in the Rajaram Kohli project.
The report also noted how expenses of Games-related facilities at the trade fair or ITPO were revised from Rs 28.02 crore to Rs 75.77 crore.

EMAAR MGF, the developers of the games village, indicted for causing loss to the exchequer.
The EMAAR MGF, the developers of the games village sold 333 flats at a higher price. The overall price was hiked from Rs 134 crore to 222 crore.
The Report also found unauthorized payment of Rs.64 Crore to EMAAR MGF.
non-levying of liquidation damages leads to a loss of 81.45 crore
carriage cost of unsold apartments was estimated at Rs 40 crore per annum.
The report also recommended action against EMAAR MGF for acts of omission and commission and has asked for a detailed probe by income tax.
The questions must be asked about why a bail-out package of Rs 728.89 crore was given to EMAAR MGF by DDA.
EMAAR MGF presented a hiked price of Rs 11,000/sq ft instead of the original price of Rs 7,829/sq ft.
The report also fixed the responsibility on following officials who played a key role in determining bail out package for EMAAR MGF. The report also recommended the Government to take action against all public servants named and involved.

Who is Sandeep Wadhwa?
Sandeep Wadhwa is the MD of Comfort Net, the company which was part of Switzerland-based Nussli India Consortium.
Nussli India was given a contract of nearly Rs 140 crore for supply of tents, portable cabins, containers and other items for six venues.
CBI sources claimed they had evidence of the company resorting to illegal means to win the Rs 140 crore overlays contract. "We have found money trail to this company. Wadhwa paid money to OC officials to get the contract.
We cannot disclose the names of those officials right now because investigations are on but we have found links of kickbacks," a CBI official said.

"It is alleged that the accused officers abused their official position and entered into criminal conspiracy with a Switzerland-based company and other unknown persons to cheat the government in awarding contract to the said company for acquiring Timing, Scoring and Result (TSR) System at exorbitant rates of Rs. 107 crore thereby causing huge loss to the government," a CBI spokesperson said.

K U K Reddy, s senior official of the Commonwealth Organizing Committee and Praveen Bakshi, Director of a private company, was today sent to five days of CBI custody by a Delhi court in connection with alleged irregularities in overlays supply.
Reddy, Additional Director General of Commonwealth Games Organising Committee and Bakshi, Director of ESA JV, was booked on the charge of bribery.
CBI submitted Bakshi has paid a huge bribe to the officials of the organizing committee in return for getting contracts at exorbitant rates.
"I am satisfied that the prayer for 5-day police custody remand of both the accused is just. Accordingly, both the accused are remanded to police custody till February 28," Special CBI judge O P Saini said.
Media has reported that Suresh Kalmadi will be arrested after the conclusion of National Games in Jharkhand on February 26.

The Committee said that based on documents available it has concluded that the actual cost of the contract awarded to SIS LIVE was at best about Rs. 111 crore, thus resulting in a profit of at least Rs. 135 crore for SIS LIVE and Zoom Communications
Prime Minister Manmohan Singh had on October 15 constituted the committee to be headed by Mr. Shunglu, a former Comptroller and Auditor General, to investigate and report within three months its findings.
What was the Purpose or Duty of the Shunglu Committee a 2 member committee?
Answer –
To Look into issues relating to organizing and conduct of common wealth games Delhi 2010 and lessons to be learnt for the future.
The Host City Contract was signed as early as November 2003.
The OC took its own time to communicate formally to the Ministry that Prasar Bharati would be the Host Broadcaster.
The OC communicated the entrustment of Host Broadcasting role to Prasar Bharati in March 2007, over three years after the signing of Host City Contract.
Indian Olympic Association / Organizing Committee together with the Government
of National Capital Territory of Delhi and Government of India entered into Host City Contract with the Commonwealth Games Federation on 13th November, 2003 for holding of XIX Commonwealth Games in Delhi during 03-14 October 2010.
The Host City Contract identifies and binds the five key stakeholders: CGF, IOA, OC, GNCTD and GOI, who are responsible for the successful delivery of the XIX Commonwealth Games 2010.
The major responsibilities of the stakeholders were as follows:
Sports Infrastructure -
Ministry of Youth Affairs & Sports, Govt. of Delhi; Delhi Development Authority (DDA) and New Delhi Municipal Council (NDMC)
City Infrastructure -
City Government ; Municipal Council of Delhi (MCD) and NDMC

This report contains the findings and conclusions of the High Level Committee (HLC)
on the management of the responsibility relating to Host Broadcasting.
The Chairman OC, CWG 2010 formally entrusted the responsibility of the Host Broadcaster to Prasar Bharati in March 2007.
The OC and Prasar Bharati entered into a ‘Right Holder Broadcaster Agreement’ in
September, 2010 which granted Television Broadcast Rights and Radio Broadcast Rights for the Games within India to Prasar Bharati
The agreement also provided for revenue sharing between OC & Prasar Bharati of all Television Broadcast Rights.
The net revenue realization arising from International Broadcast Rights sales by the OC from outside India was to be shared in the ratio of 70:30 between OC and Prasar Bharati and in the ratio of 60:40 for net revenue arising out of sale of Television and Radio Broadcast of the Games within India
The total approved expenditure for Host Broadcasting, setting up of International Broadcasting Centre and Media Press Centre was 482.57 crore. This included a loan of 187 crore to Prasar Bharati.
The Ministry constituted an Oversight Committee headed by Minister, I & B to monitor the progress for performing Host Broadcasting functions. The Oversight Committee met on six occasions till September 2010
First Report of HLC on Host Broadcasting – Know and understand the findings of Shunglu Report.
1.
Contracts were awarded by Prasar Bharati for various Host Broadcast activities without ensuring reasonableness of rates, overruling suggestions received.
2.
Prasar Bharati takes major decisions with the approval of Prasar Bharati Board. The Board is vested with the responsibility of general superintendence, direction and management of the affairs of the Prasar Bharati Broadcasting Corporation. Approval of the Board was not taken for many major financial and management issues relating to Host Broadcasting operations.
3.
“Vigilance inquiry found that from the year 2006 to 2009 there was exponential increase in payments made to the legal entities engaged by Prasar Bharati and 78% of these payments were on account of engaging senior private advocates at ad hoc rates.
The panel of regular advocates was reduced so as to create grounds for increased engagement of private advocates.
Unjustifiably high rates were paid to the advocates and in some cases; the payments made were significantly higher than the terms of engagement.
The whole process of engagement of senior private advocates was based on decisions taken by the CEO without the approval of the Prasar Bharati Board.”

It is incumbent upon any agency to satisfy itself about the reasonableness of price of goods and services.
Prasar Bharati did not verify reasonableness of the rates quoted by the successful bidders, with help of various means available to it.
Prasar Bharati failed to do so despite being advised by the Ministry of me & B and its Finance wing. This trend was noticed in all major contracts.
5.
Most of the decisions to support and award the inflated bids were taken by Director General (Doordarshan) and the then Chief Executive Officer despite strong contrary view.That entire work in Doordarshan was being carried out in a highly unprofessional manner with complete lack of transparency.
6.
Decision to Telecast Games in India on HD format was questionable.
7.
Even after spending over 350 crore as Host Broadcaster, Prasar Bharati, today neither possesses adequate number of equipment required for HDTV nor is its technical staff fully trained and experienced to handle similar jobs in future.
If any other major international sports event is organized in the country at a future date, Prasar Bharati may again have to fall back upon foreign consultants, Broadcasting Companies and service providers!
8.
The HLC has come across instances where the HB Project Cell was repeatedly obstructed and overruled by the CEO / DG (DD) on matters of contract performance and additional benefits to the contractor, in particular, SIS LIVE.
9.
The procedures and best practices in the selection of service providers were ignored or bypassed to favor certain entities.
10.
The technical staff of Doordarshan had confirmed their capacity and readiness to cover the production of 10 out of 17 events in Commonwealth Games, Delhi 2010.
Coverage of the remaining 7 events and Opening and Closing ceremony, which required specialization, was proposed to be outsourced.
Despite initiation of preliminary work for covering 10 events in-house in the year 2007 with the assistance of an international consultant hired by OC, this decision was abandoned by Prasar Bharati without any recorded reasons.

In the Commonwealth Youth Games, Pune, 2008, efforts were made to award contract for Host Broadcasting to SIS Outside Broadcast Ltd. UK which was declared as the only technically qualified bid out of 10 responses received in the year 2008.
The tender process was discharged as Central Vigilance Commission had found the eligibility criteria flawed and unduly restrictive.
The CWYG were covered in-house by Doordarshan at a cost of 7.50 core against the bid amount of 42.30 crore of SIS Outside Broadcast. Irregular award of contract at a cost of 1.6 crore to Zoom Communications, Delhi for the hiring of broadcast equipment in CWYG, Pune 2008 was also adversely commented upon by Central Vigilance Commission.

As per the contract signed with SIS LIVE, the entity was to provide a ‘turnkey solution' for the functions related to generation of basic feed, broadcast venue operations and services and training of PB staff.
The functions related to broadcast venue operations and services were not performed by SIS LIVE and were outsourced by Prasar Bharati to other agencies through separate contracts.
13.
Prasar Bharati did not heed the lessons of the CWYG, 2008 where it had glaring evidence of a highly inflated bid by SIS LIVE which was almost six times the actual in-house cost of production and coverage by Prasar Bharati.
It did not put in place systems to address the concerns voiced by the Central Vigilance Commission on the contracts for CWYG, 2008.

Doordarshan possessed the capability to coordinate and broadcast ten of the seventeen games.
15.
The Executive Director of Zoom Communications (Shri Vaseem Ahmed Dehlvi), to whom the SIS LIVE ultimately entrusted the entire production and coverage work ‘back-to-back’ at a price that was 69 crore less than the Prasar Bharati-SIS LIVE contract, attended all meetings in Prasar Bharati along with the representatives of SIS LIVE before the signing of contract. After the contract was signed, he continued to represent SIS LIVE in all meetings, though he was working for Zoom Communications.

These circumstances clearly establish that DG (DD) and CEO Prasar Bharati were aware of the simultaneous assignment of Production and Coverage responsibility by SIS LIVE to Zoom Communication; that they were two faces of the same coin and that their protestations to the contrary, post-survey operations by Income Tax (5th October, 2010), were disingenuous.

A clear nexus between SIS LIVE, Zoom Communications and elements of Prasar Bharati management was apparent from the sequence of events, starting from CWYG, Pune 2008.

It was also gathered that on several occasions the HB Project Cell officers were reprimanded in the presence of the contractors for insisting on compliance to the terms of the contract. The representative of SIS LIVE (effectively Zoom Communications) even asked for transfer of some of the staff members in the HB Cell.

Prasar Bharati informed the Ministry and Oversight Committee (Meeting of 22nd October, 2009) that the bid for Production and Coverage of SIS LIVE (246 crore) was 26 percent lower than the bid quoted for similar components and activities during Request for Information.
This was a misleading, false and factually incorrect statement.
Apart from the fact that the figure of 6.55 million GBP ( 52 crore) quoted by BBC Outside Broadcasts for production and coverage of 12 events was never brought on record or discussed, the offer of $84.93 million ( 336 crore) by HBS-IMG consortium was for 'turnkey' solution which included overall management, IBC, production, venue operations, other operational items and management fee.
The amount quoted for Production and Coverage, as a line item, was only $43.18 million (172 crore).

SIS LIVE had provided a list of 62 foreign based key personnel, in the technical proposal, who were to be deployed in the CWG Delhi, 2010.

During negotiations with SIS LIVE on these costs, the company had refused to reduce the same. Comparison with the list of persons provided accreditation by OC revealed that SIS LIVE / Zoom Communications had brought only about 858 persons from outside the country and the remaining persons were outsourced locally.

As per the RFP, the selected entity was to provide coverage to Queen’s Baton Relay in 21 countries but SIS LIVE produced news stories from only 16 countries

Under the provisions of the contract and international practice, the entity had to set up a separate site office during games for overseeing the operations at various venues.
No such separate office was set up by SIS LIVE and instead SHAF and Global Television the contractors for setting up International Broadcasting Centre were pressurized to permit SIS LIVE to set up site office in Hall no. 8 and 9 at ITPO which space was meant for IBC operations. Furniture purchased by Prasar Bharati at a cost of 20.71 lakh was provided to SIS LIVE for the office.

The financial bid of SIS LIVE (P & C) and Global and Shaf (IBC) had a provision of 4.72 crore and 0.50 crore in their financial bids for food for its crew and staff.
SIS (Live) stated that amount of 4.72 crore included in the bid was meant for per diem cost during Games period and food cost prior to Games. In the weekly review meeting but Prasar Bharati, however, provided free catering facilities at venues to the employees of SIS LIVE and Global and Shaf (IBC) at a cost of 1.10 crore, which was inadmissible and constituted ‘benefit’ to these entities.

SIS LIVE was required to provide commentary equipment for 70 units proposed to be set-up at various venues in accordance with the provisions of RFP and contract signed with the entity. Equipment for setting up of only 31 units was provided by SIS LIVE but no action for breach of contract was taken.

Ignoring the advice given, Prasar Bharati hired HDTV specific broadcast equipment from SIS LIVE at a cost of 6.50 crore for covering Commonwealth Games within the country.
The hiring was done at exorbitant rates and aggregated to about 50 percent of the cost of purchase of state of art equipment of comparable quality.
It will be worthwhile to note that no other Right Holding Broadcaster, other than DD, hired equipment from SIS LIVE on rate card for the purpose of broadcasting.Based on documents made available, the High Level Committee has concluded that the actual cost of the contract awarded to SIS LIVE was at best about 111 crore; thus resulting in a profit of at least 135 crore for SIS LIVE and Zoom Communications.

Shunglu Committee Submitted First Report to Government of India -

The Committee said that based on documents available it has concluded that the actual cost of the contract awarded to SIS LIVE was at best about Rs. 111 crore, thus resulting in a profit of at least Rs. 135 crore for SIS LIVE and Zoom Communications
Prime Minister Manmohan Singh had on October 15 constituted the committee to be headed by Mr. Shunglu, a former Comptroller and Auditor General, to investigate and report within three months its findings.
What was the Purpose or Duty of the Shunglu Committee a 2 member committee?

To Look into issues relating to organizing and conduct of common wealth games Delhi 2010 and lessons to be learnt for the future.
The Host City Contract was signed as early as November 2003.
The OC took its own time to communicate formally to the Ministry that Prasar Bharati would be the Host Broadcaster.
The OC communicated the entrustment of Host Broadcasting role to Prasar Bharati in March 2007, over three years after the signing of Host City Contract.
Indian Olympic Association / Organizing Committee together with the Government
of National Capital Territory of Delhi and Government of India entered into Host City Contract with the Commonwealth Games Federation on 13th November, 2003 for holding of XIX Commonwealth Games in Delhi during 03-14 October 2010.
The Host City Contract identifies and binds the five key stakeholders: CGF, IOA, OC, GNCTD and GOI, who are responsible for the successful delivery of the XIX Commonwealth Games 2010.
The major responsibilities of the stakeholders were as follows:

This report contains the findings and conclusions of the High Level Committee (HLC)
on the management of the responsibility relating to Host Broadcasting.
The Chairman OC, CWG 2010 formally entrusted the responsibility of the Host Broadcaster to Prasar Bharati in March 2007.
The OC and Prasar Bharati entered into a ‘Right Holder Broadcaster Agreement’ in
September, 2010 which granted Television Broadcast Rights and Radio Broadcast Rights for the Games within India to Prasar Bharati
The agreement also provided for revenue sharing between OC & Prasar Bharati of all Television Broadcast Rights.
The net revenue realization arising from International Broadcast Rights sales by the OC from outside India was to be shared in the ratio of 70:30 between OC and Prasar Bharati and in the ratio of 60:40 for net revenue arising out of sale of Television and Radio Broadcast of the Games within India
The total approved expenditure for Host Broadcasting, setting up of International Broadcasting Centre and Media Press Centre was 482.57 crore. This included a loan of 187 crore to Prasar Bharati.
The Ministry constituted an Oversight Committee headed by Minister, I & B to monitor the progress for performing Host Broadcasting functions. The Oversight Committee met on six occasions till September 2010
First Report of HLC on Host Broadcasting – Know and understand the findings of Shunglu Report.
1.
Contracts were awarded by Prasar Bharati for various Host Broadcast activities without ensuring reasonableness of rates, overruling suggestions received.

Prasar Bharati takes major decisions with the approval of Prasar Bharati Board. The Board is vested with the responsibility of general superintendence, direction and management of the affairs of the Prasar Bharati Broadcasting Corporation. Approval of the Board was not taken for many major financial and management issues relating to Host Broadcasting operations.

“Vigilance inquiry found that from the year 2006 to 2009 there was exponential increase in payments made to the legal entities engaged by Prasar Bharati and 78% of these payments were on account of engaging senior private advocates at ad hoc rates.
The panel of regular advocates was reduced so as to create grounds for increased engagement of private advocates.
Unjustifiably high rates were paid to the advocates and in some cases; the payments made were significantly higher than the terms of engagement.
The whole process of engagement of senior private advocates was based on decisions taken by the CEO without the approval of the Prasar Bharati Board.”

It is incumbent upon any agency to satisfy itself about the reasonableness of price of goods and services.
Prasar Bharati did not verify reasonableness of the rates quoted by the successful bidders, with help of various means available to it.
Prasar Bharati failed to do so despite being advised by the Ministry of me & B and its Finance wing. This trend was noticed in all major contracts.

Most of the decisions to support and award the inflated bids were taken by Director General (Doordarshan) and the then Chief Executive Officer despite strong contrary view.That entire work in Doordarshan was being carried out in a highly unprofessional manner with complete lack of transparency.

Decision to Telecast Games in India on HD format was questionable.

Even after spending over 350 crore as Host Broadcaster, Prasar Bharati, today neither possesses adequate number of equipment required for HDTV nor is its technical staff fully trained and experienced to handle similar jobs in future.
If any other major international sports event is organized in the country at a future date, Prasar Bharati may again have to fall back upon foreign consultants, Broadcasting Companies and service providers!

The HLC has come across instances where the HB Project Cell was repeatedly obstructed and overruled by the CEO / DG (DD) on matters of contract performance and additional benefits to the contractor, in particular, SIS LIVE.
9.
The procedures and best practices in the selection of service providers were ignored or bypassed to favor certain entities.
10.
The technical staff of Doordarshan had confirmed their capacity and readiness to cover the production of 10 out of 17 events in Commonwealth Games, Delhi 2010.
Coverage of the remaining 7 events and Opening and Closing ceremony, which required specialization, was proposed to be outsourced.
Despite initiation of preliminary work for covering 10 events in-house in the year 2007 with the assistance of an international consultant hired by OC, this decision was abandoned by Prasar Bharati without any recorded reasons.

In the Commonwealth Youth Games, Pune, 2008, efforts were made to award contract for Host Broadcasting to SIS Outside Broadcast Ltd. UK which was declared as the only technically qualified bid out of 10 responses received in the year 2008.
The tender process was discharged as Central Vigilance Commission had found the eligibility criteria flawed and unduly restrictive.
The CWYG were covered in-house by Doordarshan at a cost of 7.50 core against the bid amount of 42.30 crore of SIS Outside Broadcast. Irregular award of contract at a cost of 1.6 crore to Zoom Communications, Delhi for the hiring of broadcast equipment in CWYG, Pune 2008 was also adversely commented upon by Central Vigilance Commission.

As per the contract signed with SIS LIVE, the entity was to provide a ‘turnkey solution' for the functions related to generation of basic feed, broadcast venue operations and services and training of PB staff.
The functions related to broadcast venue operations and services were not performed by SIS LIVE and were outsourced by Prasar Bharati to other agencies through separate contracts.

Prasar Bharati did not heed the lessons of the CWYG, 2008 where it had glaring evidence of a highly inflated bid by SIS LIVE which was almost six times the actual in-house cost of production and coverage by Prasar Bharati.
It did not put in place systems to address the concerns voiced by the Central Vigilance Commission on the contracts for CWYG, 2008.

Doordarshan possessed the capability to coordinate and broadcast ten of the seventeen games.

The Executive Director of Zoom Communications (Shri Vaseem Ahmed Dehlvi), to whom the SIS LIVE ultimately entrusted the entire production and coverage work ‘back-to-back’ at a price that was 69 crore less than the Prasar Bharati-SIS LIVE contract, attended all meetings in Prasar Bharati along with the representatives of SIS LIVE before the signing of contract. After the contract was signed, he continued to represent SIS LIVE in all meetings, though he was working for Zoom Communications.

These circumstances clearly establish that DG (DD) and CEO Prasar Bharati were aware of the simultaneous assignment of Production and Coverage responsibility by SIS LIVE to Zoom Communication; that they were two faces of the same coin and that their protestations to the contrary, post-survey operations by Income Tax (5th October, 2010), were disingenuous.

A clear nexus between SIS LIVE, Zoom Communications and elements of Prasar Bharati management was apparent from the sequence of events, starting from CWYG, Pune 2008.

It was also gathered that on several occasions the HB Project Cell officers were reprimanded in the presence of the contractors for insisting on compliance to the terms of the contract. The representative of SIS LIVE (effectively Zoom Communications) even asked for transfer of some of the staff members in the HB Cell.

Prasar Bharati informed the Ministry and Oversight Committee (Meeting of 22nd October, 2009) that the bid for Production and Coverage of SIS LIVE (246 crore) was 26 percent lower than the bid quoted for similar components and activities during Request for Information.
This was a misleading, false and factually incorrect statement.

Corruption Common wealth games, CWG - CBI raids Suresh Kalmadi after 2 months
The Central Bureau of Investigation (CBI) on Friday raided the residences of Commonwealth Games Organizing Committee chief Suresh Kalmadi and his personal secretary Manoj Bhure in New Delhi and in Pune in connection with alleged irregularities in the conduct of the Games.
The raids began at about 7 a.m. this morning when ten CBI sleuths simultaneously entered both the premises.
A team of CBI official conducted raids at his residence in New Delhi for almost eight hours and seized several documents, two laptops and some central processing units.
The CBI also raided at Kalmadi's residence in central Mumbai.
CBI officials also raided his residences and offices in Pune along with his brother's house in Mumbai. The investigating agency is also questioning his personal secretaries Manoj Bhore, Vinod Surve and Shekhar.
The CBI also raided the residence of Kalmadi's personal secretary PS Manoj Bhore in Pune.
Few days back CBI has requested the congress government to remove Kalmadi and his aide Lalit Bhanot from the CWG Organizing Committee.

CWG Scam – Court grants bail to accused Sanjay Mahendroo and TS Darbari –
The Court had granted bail to TS Darbari after the CBI failed to file the chargesheet against him for alleged misappropriations in the Queen Baton's relay in London in 2009.
Darbari got the bail as CBI prosecutor informed the court that the agency cannot file the chargesheet within the stipulated 60 days prescribed under the CrPC since investigations have not been completed.
Another accused Sanjay Mahendroo he also got bail from Delhi court in the case of Queen Baton's Relay in London in 2009.
3rd accused is Jayachandran if CBI does not file chargesheet before January 20 then he will also get the bail and he will be out of jail.
The accused are facing charges of causing losses to the exchequer in award of contract to the tune of Rs. 1.55 crore with regard to the Queen Baton's Relay on October 29, 2009 in London

CBI has arrested the head of a private firm, Binu Nanu, Director GL Events – Meroform which had bagged over Rs. 150 crore contracts from Commonwealth Games Organising Committee for overlays works.
After arrest he was remanded to 4 days police custody.
The CBI had on January 12 searched office and residence premises of Nanu
Nanu's wife Roopana is also one of his associate in the business.
Overlays works included supply of tents, marquees, prefabricated units, portable toilets, containers, security fences, furniture, public display LED boards, floor finishes, material handling equipment, gensets, cabling, UPS, lighting, air-conditioners, civil construction, athletic exercise equipment and grandstands.

If common mans home is raided you can understand what will happen with him.
In which situation any person will become fearless and he does not fear or care what CBI or investigating agency is doing.
What is the use of search and raids after two months, no criminal personal will keep the theft money or black money at home, when he knows that soon his home will be raided.

CWG Scam – Court grants bail to accused Sanjay Mahendroo and TS Darbari –
The Court had granted bail to TS Darbari after the CBI failed to file the chargesheet against him for alleged misappropriations in the Queen Baton's relay in London in 2009.
Darbari got the bail as CBI prosecutor informed the court that the agency cannot file the chargesheet within the stipulated 60 days prescribed under the CrPC since investigations have not been completed.
Another accused Sanjay Mahendroo he also got bail from Delhi court in the case of Queen Baton's Relay in London in 2009.
3rd accused is Jayachandran if CBI does not file chargesheet before January 20 then he will also get the bail and he will be out of jail.
The accused are facing charges of causing losses to the exchequer in award of contract to the tune of Rs. 1.55 crore with regard to the Queen Baton's Relay on October 29, 2009 in London

CBI has arrested the head of a private firm, Binu Nanu, Director GL Events – Meroform which had bagged over Rs. 150 crore contracts from Commonwealth Games Organising Committee for overlays works.
After arrest he was remanded to 4 days police custody.
The CBI had on January 12 searched office and residence premises of Nanu
Nanu's wife Roopana is also one of his associate in the business.
Overlays works included supply of tents, marquees, prefabricated units, portable toilets, containers, security fences, furniture, public display LED boards, floor finishes, material handling equipment, gensets, cabling, UPS, lighting, air-conditioners, civil construction, athletic exercise equipment and grandstands.

Every one in India knows corruption happened in CWG.
How many government organizations are inquiring into common wealth games corruption?
Following government organizations are doing inquiries into common wealth games corruption.
•CAG
•CVC
•ED,
•Income Tax
•CBI
Regarding common wealth games thousands of contracts were done by common wealth games organization committee.
Currently CVC is looking into just about 18 contracts or 20.
Don’t you think CVC needs to check every contract and for that CVC should hire services of collage going boys and girls who will help CVC free of cost to find out the common wealth games criminals.
Or help of social organizations which will happily help them track the corruption.
What ED is doing ?
ED is only investigating foreign exchange related matters.
CAG and CVC are doing their duties but problem with these both organizations is that they have limited jurisdiction.
They do not have power to file direct police complaint .
To be honest both organization are toys in the hands of politicians and CBI , politicians have put their locket in the neck of CBI and the chain connected to locket is in the hands of politicians who CBI moves in the direction in which chain is pulled.
While writing this I remember my friends dog Jackie , he is no more, but he was so trained , he didn’t required chain , we just shouted and Jackie obeyed us like bringing ball etc.
All the above organizations are inquiring into this common wealth games corruption.
But now comedy is that I think Prime Minister MMS also do not trust all these organizations so our own Prime Minister MMS appointed another committee.
The committee name is Shunglu committee.
In first instance like me I also became happy, but later as I started read and gather information and I came to conclusion that this committee is also useless it will find nothing.
Let’s understand why this is going to happen.
Shunglu committee is powerless it does not happen any powers
it can not even demand or order to any office to show them the official files.
Shunglu committee does not have power to call for records or call for files.
Suppose Shunglu committee tells any office please send me xyz file, and that office does not send the file to Shunglu committee then what will happen.
The committee can not send them to jail or give them any kind of punishment.
The committee will just forget about the file.
One more comedy is that this committee will get money like Supreme Court judges.
But the committee is not given the powers of Supreme Court judges.
What is use of committee which is not supported by any law, which has no power?
If committee does not have the powers like Supreme Court judge
Then what is the reason committee is given money or salary like Supreme Court judge
Do you think officials will obey to committee which is appointed by Prime Minster without any power to summon, or give any kind of punishment?
We have seen Minister named Raja ignored Prime Minister what Prime Minister has done he is mum, same way Shunglu committee is going to work.
Request the officials if they do not cooperate keep mum.
Mum means keeping silence.
So if you got any expectation from this committee forget it.
Now here comes the role of media.
Media should daily send a reporter to Shunglu committee office or his home and ask him what committee has done?
And in news they should declare that today also shunglu committee rested did no work or they requested officials to send files to particular office and report has arrived that the files lost in transit .
If reporting is done like this then I am sure committee will feel the pressure and they will do something.
Does media is trying to find how much money common wealth games earned as profits.
Can common wealth games repay the loan amount which it has taken from government?

No Auction = dishonesty, fraud, cheating
The Delhi Development Authority (DDA) is planning to give away 90 per cent of the CWG flats to the same bureaucrats who could have been involved in corruption.
At present, the DDA owns over 700 flats out of the total of 1,168 flats.
As per media, only 100 flats will be auctioned to the public.
Remaining flats will be sold to Delhi Government.
Please pay attention.
Using whose money Delhi Government will purchase remaining flats?
Answer is Indian Tax payer’s money.
Once Delhi Government becomes owner of these flats what will happen ?
Is it not possible Delhi government will sell these flats to politicians at a nominal value or with the discount of 90% or 99%.
If DDA is honest they should auction all the flats for public if politicians want flat then can also bid with the public.

CBI registered two cases in connection with alleged irregularities during the Queen''s Baton''s Relay in London and carried out searches at CWG Organising Committee’s office and at residences of some of its former officials.
The two cases were registered against London-based AM Films and AM Car, which had been given contracts for the Baton Relay, official sources said.
The searches were conducted at the residence of T S Darbari, joint director general of the Commonwealth Games Organising Committee,
Sanjay Mahendroo, OC deputy director-general, and Raj Singh, a Director level officer in the OC
T S Darbari, who was sacked from the Commonwealth Games Organising Committee shortly before the Games was a close aide of Suresh Kalmadi who was Chairman of the Committee.
After conducting raids, officials of Central Bureau of Investigation (CBI) arrested Commonwealth Games' top officials for their alleged role in some of the corruption charges related to the Games.
Darbari was the joint director general of the Commonwealth Games Organising Committee (CWG OC), where as Mahendroo was the joint director general of the CWG OC.
CBI has found proof that two emails that justified selection of AM Cars for the Queen's Baton Relay were forged. The emails were used to exaggerate bills.
The email was used by Kalmadi aides Darbari and Mahendroo to justify high rentals and to hire AM cars.
The first case names London-based A M Car/Van Services and its owner Ashish Patel besides Darbari, Mahendroo and Singh under
Sections 468 (forgery of court records and public documents),
471 (Using forged documents as genuine),
120-B (criminal conspiracy) of IPC and Prevention of Corruption Act.
The second case involves London-based A M Films, Patel, Mahendroo, Darbari and others under
Sections 420 (cheating),
120-B (criminal conspiracy) of IPC and Prevention of Corruption Act.
Update – 22 November 2010 -
CBI arrested sacked treasurer of Commonwealth Games Organizing Committee M Jayachandran in connection with Queen's Baton Relay (QBR) in London last year.
CBI spokesman R K Gaur said the former OC official was arrested in connection with the ongoing investigation in the two cases registered by the CBI earlier this week.
Jayachandran has also been questioned by the Enforcement officials for over six hours as part of its probe into the alleged financial irregularities in the mega sporting event.
His explanation was sought on questions related to alleged foreign exchange violations during the QBR.
The ED had issued summons to him under the provisions of the Foreign Exchange Management Act (FEMA).

Government of India has given, conferred the status of a Supreme Court judge on V.K. Shunglu, head of the high-level committee to go into the alleged financial irregularities
Now the Shunglu panel will get the powers, authority to summon officials, inspect records, and confiscate papers and to look into all the official documents pertaining to the common corruption wealth games.
Prime Minister Manmohan Singh had on October 15 constituted the committee to be headed by Mr. Shunglu, a former Comptroller and Auditor General, to investigate and report within three months its findings.
According to the PMO, the Committee will have as its second member Shantanu Consul, Secretary, Department of Personnel and Training, after his retirement on October 30
The committee will examine the "weaknesses in management, alleged misappropriation, irregularities, wasteful expenditure and wrongdoing in the conduct of the Games and recommend action".
It would also probe the issues relating to the effectiveness of the organisational structure and governance for organization, preparation and conduct of the Games at all levels, including the Organizing Committee and its key functional areas.
“The Terms of Reference (ToR) are wide and comprehensive. We will go in to every aspect of the complaints (related to the scam),” Mr. Shunglu told PTI.
The Prime Minister’s Office has announced a 10-point ToR for the Shunglu panel to investigate the weaknesses in management, alleged misappropriation, irregularities and wrongdoing in the conduct of the Games held here between October 3-14.
Terms of Reference of High Level Committee to Look into the Organization and Conduct of the Commonwealth Games – 2010
Government has approved the constitution of a High Level Committee (HLC) headed by V.K. Shunglu, the former Comptroller & Auditor General of India, to look into the organization and conduct of the Commonwealth Games – Delhi 2010 and also to draw lessons from it. The second member of the Committee will be Shantanu Consul (IAS: KTK: 74), Secretary, Department of Personnel & Training, upon his retirement on 31st October, 2010.
Government has also approved the terms of reference for the Committee as under:
i) The role and responsibilities of the signatories to the Host City Contract and the overall implications of the obligations entered into through the Host City Contract;
ii) The planning and execution of development projects related to the Games and contracts for service delivery, with reference to time, cost and quality;
iii) The issues relating to the effectiveness of the organizational structure and governance for organization, preparation and conduct of the Games at all levels, including the Organizing Committee and its Key Functional Areas;
iv) Examination of weaknesses in management, alleged misappropriation, irregularities, wasteful expenditure and wrongdoing in the conduct of the Games, and, recommending action on the same;
v) The issues relating to financing the Games, including estimates of revenue and expenditure;
vi) The issues concerning coordination amongst various agencies involved in the development of infrastructure and conduct of the Games;
vii) The role of international/national advisors/consultants/officials of the Organizing Committee in the conduct of the Games;
viii) The overall impact of the Games including legacy for city infrastructure, sports infrastructure and sports development;
ix) The lessons learnt for the future, on each of the above, including establishment of a mechanism for laying down timeframes and effective monitoring, creation of a legally sustainable framework for hosting similar international sporting events, appropriate financial management and internal audit, media interaction and communication;
x) Any other areas considered relevant by the Committee.
The HLC will submit its report within three months.
It will decide its own procedures and mode of enquiry.
All Ministries and Departments of the Central and State Governments, as well as agencies and organizations under their administrative control, have been directed to extend their full cooperation and assistance to the HLC in completing its assignment within this time.
The Ministry of Sports will extend administrative and logistic support to the Committee.
It will function from its office in Vigyan Bhawan.
The Comptroller & Auditor General of India (C&AG), Central Vigilance Commission (CVC) and other agencies will independently carry out their audit and investigations, in accordance with their respective mandates.
All complaints referred to various agencies will be looked into and action taken immediately by the agency concerned.
The HLC will recommend action on any matter that comes to its notice involving alleged misappropriation, irregularities, wasteful expenditure or wrongdoing, and, they will take immediate action as warranted under the law.
The HLC will also consider any complaint from any member of the public, duly supported by documents, with respect to its remit i.e. organization and conduct of the Commonwealth Games – Delhi 2010. The HLC will inform the members of the public regarding its availability to receive such complaints, in due course.
The Enforcement Directorate is one of the agencies scanning the contracts and expenses made in connection with the Commonwealth Games.
Commonwealth Games Organising Committee Director-General VK Verma appeared before the Enforcement Directorate for questioning in connection with Queen's Baton Relay event in London. Verma, who has been summoned as a witness, has been asked to explain the commercial deals including the AM Films contract.
A case has already been had registered under FEMA after British authorities referred to the Indian High Commission a matter regarding AM Films to which a huge sum of money was transferred through the Royal Bank of Scotland.

The committee is saying that they the lack of time forced them to do deal with AM films.-
"The Committee noted that out of the offers, the offer of A M Films, UK at GBP 127712 exclusive of taxes is cheaper compared to other vendors
Point to be checked – Every other vendor should be asked, does the real companies on that address are present or those are the fake companies , created to just give deal to AM films.
Media should check this, if those companies are real then it is good, but what if those companies are fake and created to just grab this contract.

Income tax department raids – in connection with common wealth games corruption probe.
The companies, which were raided, include Shiv Naresh Sports Pvt Ltd and Satya Prakash Constructions.
Shiv Naresh laid synthetic tracks for the Commonwealth Games
While Satya Prakash Constructions was responsible for landscaping.
Another company raided was Sweka Powertech Engineers, which provided the street lighting.
MBL Infrastructure of Kolkata, which provided civil infrastructure, was also raided.
Officials said that the Income Tax department would specifically look into the contracts awarded by the CWG Organizing Committee and the role of its officials and contractors including charges of bribing.

The second member of the Committee will be Shantanu Consul (IAS: KTK: 74), Secretary, Department of Personnel & Training, upon his retirement on 31st October, 2010.
Government has also approved the terms of reference for the Committee as under:
i) The role and responsibilities of the signatories to the Host City Contract and the overall implications of the obligations entered into through the Host City Contract;
ii) The planning and execution of development projects related to the Games and contracts for service delivery, with reference to time, cost and quality;
iii) The issues relating to the effectiveness of the organizational structure and governance for organization, preparation and conduct of the Games at all levels, including the Organizing Committee and its Key Functional Areas;
iv) Examination of weaknesses in management, alleged misappropriation, irregularities, wasteful expenditure and wrongdoing in the conduct of the Games, and, recommending action on the same;
v) The issues relating to financing the Games, including estimates of revenue and expenditure;
vi) The issues concerning coordination amongst various agencies involved in the development of infrastructure and conduct of the Games;
vii) The role of international/national advisors/consultants/officials of the Organizing Committee in the conduct of the Games;
viii) The overall impact of the Games including legacy for city infrastructure, sports infrastructure and sports development;
ix) The lessons learnt for the future, on each of the above, including establishment of a mechanism for laying down timeframes and effective monitoring, creation of a legally sustainable framework for hosting similar international sporting events, appropriate financial management and internal audit, media interaction and communication;
x) Any other areas considered relevant by the Committee.
The HLC will submit its report within three months.
It will decide its own procedures and mode of enquiry.
All Ministries and Departments of the Central and State Governments, as well as agencies and organizations under their administrative control, have been directed to extend their full cooperation and assistance to the HLC in completing its assignment within this time.
The Ministry of Sports will extend administrative and logistic support to the Committee.
It will function from its office in Vigyan Bhawan.
The Comptroller & Auditor General of India (C&AG), Central Vigilance Commission (CVC) and other agencies will independently carry out their audit and investigations, in accordance with their respective mandates.
All complaints referred to various agencies will be looked into and action taken immediately by the agency concerned.
The HLC will recommend action on any matter that comes to its notice involving alleged misappropriation, irregularities, wasteful expenditure or wrongdoing, and, they will take immediate action as warranted under the law.
The HLC will also consider any complaint from any member of the public, duly supported by documents, with respect to its remit i.e. organization and conduct of the Commonwealth Games – Delhi 2010. The HLC will inform the members of the public regarding its availability to receive such complaints, in due course.
The Enforcement Directorate is one of the agencies scanning the contracts and expenses made in connection with the Commonwealth Games.
Commonwealth Games Organising Committee Director-General VK Verma appeared before the Enforcement Directorate for questioning in connection with Queen's Baton Relay event in London. Verma, who has been summoned as a witness, has been asked to explain the commercial deals including the AM Films contract.
A case has already been had registered under FEMA after British authorities referred to the Indian High Commission a matter regarding AM Films to which a huge sum of money was transferred through the Royal Bank of Scotland.

The committee is saying that they the lack of time forced them to do deal with AM films.-
"The Committee noted that out of the offers, the offer of A M Films, UK at GBP 127712 exclusive of taxes is cheaper compared to other vendors
Point to be checked – Every other vendor should be asked, does the real companies on that address are present or those are the fake companies , created to just give deal to AM films.
Media should check this, if those companies are real then it is good, but what if those companies are fake and created to just grab this contract.

Income tax department raids – in connection with common wealth games corruption probe.
The companies, which were raided, include Shiv Naresh Sports Pvt Ltd and Satya Prakash Constructions.
Shiv Naresh laid synthetic tracks for the Commonwealth Games
While Satya Prakash Constructions was responsible for landscaping.
Another company raided was Sweka Powertech Engineers, which provided the street lighting.
MBL Infrastructure of Kolkata, which provided civil infrastructure, was also raided.
Officials said that the Income Tax department would specifically look into the contracts awarded by the CWG Organizing Committee and the role of its officials and contractors including charges of bribing.

The Central Vigilance Commission probing the Commonwealth Games has found a range of discrepancies including a cost over-run of over 200 per cent on the rental of temporary fittings and installations.
The CVC has also spotted wasteful expenses like fencing for the Noida Expressway. Material was bought to cordon off the road from spectators.
But since all approach roads to the venues were blocked, the money was wasted.
The Commission also found prices in some cases were highly unjustified like
•over Rs 8 lakhs spent on per treadmill
•Rs 1 lakh per door
•Garbage bags ordered at Rs 4 each from one firm, the same bags for Rs 3000 from another
•unused overlays include water dispensers that were hired at 32 thousand rupees
Work known as overlays work was to be carried out across 62 venues for about 590 items.
The initial estimate for these works was estimated at Rs 221 crores.
But it was hiked 200 per cent to Rs 668 crores.
No proper negotiations happened and suffered loss of more than 150 or 200 crores.
cupboards that could have been ordered at Rs 8342 to be put up at the back of the flats, were hired from the same company at Rs 15,764 a piece for the front.
Small refrigerator ordered at Rs 21,030 for back of the house, was hired for Rs 38, 261 for front of the house.
Office chairs priced at Rs 1318 to be put up at the back of the house, were hired for Rs 4591.
Following 4 companies got the contract, and OC paid them money, the government of India gave this money to OC as a loan.

The CVC report says that twelve concrete samples taken from the upgraded two stadiums failed to meet the 28-day strength test.
The CVC report also finds that at least two stadiums failed quality tests but reports were tampered to show the contrary.
In flyover projects concrete core samples taken failed to meet the requirement of strength.
Specialized items of Aluminium and acoustic panes used were of inferior quality to what was agreed upon.
The monthly inspection report on quality of work was never prepared.
The Income Tax (I-T) department investigating the broadcasting rights appears to have found that London based SIS Live was given the Rs 246 crore contract by Prasar Bhrati, despite doubts over its legal status.
CVC asked CBI to probe any criminal conspiracy angle in award of certain Games-related projects.
The Income Tax department is now investigating the matter on whether Prasar Bharti favored the British company.
It is alleged that the registration number of SIS Live was forged and that the company had no valid service tax number - both a pre-requisite for the bidding process.
Under four invoices cleared so far an amount of Rs. 147.6 crore i.e. 60% of Contract value of Rs. 246 crore has been paid by PB to M/s SIS Live
It is important to mention that still 40 per cent payment is to be made and 10 per cent performance guarantee is also with Prasar Bharati.
Thus, 50% of the amount is still with Prasar Bharti.
SIS Live is a partnership formed under English law by SIS and its subsidiary SIS Outside Broadcasts Limited in order to provide outside broadcasting services.
The firm was a consortium at the time of bidding and later with proper legal advice they were permitted to become "Partnership Firm" before contract.
The need is that Indian media should high light the names of owners of these above companies, with their photographs and interviews.
Let the Indians know who is owner of these companies.
