The trial court in Chhattisgarh had set five conditions for his release.

Chhattisgarh Court of Additional District and Sessions Judge BP Verma directed that Sen be released on a personal bond and surety of Rs 50,000 each.

Sen has to surrender his passport, he can't leave India without prior permission and he has to appear before the Chhattisgarh High Court for the trial whenever required.

After hearing the case a bench comprising Justices HS Bedi and CK Prasad passed the order and granted bail to 61 year old Dr Binayak Sen.
Supreme Court said that it was giving no reason for granting bail to Dr. Sen and left it to the satisfaction of the trial court concerned to impose the conditions for his release on bail.
SC also said that even if he is a Naxal sympathizer, it does not make him guilty of sedition.
We are a democratic country. If Gandhian literature is found on some one, it doesn't make him a Gandhian.
The court also observed that possession of Naxal literature is not a proof of sedition.
While granting bail, the bench said, "We are concerned with the implementation of the judgment as even no case of sedition is made out."

Raipur Additional District and Sessions Judge B P Verma found Civil rights activist Binayak Sen, Naxal ideologue Narayan Sanyal and Kolkata businessman Piyush Guha guilty under provisions of section 124 IPC (sedition), 120 B IPC (conspiracy) and Chhattisgarh Special Public Security Act
Binayak, a PUCL activist, was arrested on May 14, 2007 from Bilaspur and was in jail for two years before being granted bail by the Supreme Court in May last year.
Dr.Sen had been accused by the prosecution of carrying messages and letters from Sanyal to the underground Maoists.
All the three were sentenced to life imprisonment under sections 124A and 120(B) of IPC.
The three were also found guilty under Section 8(1) of Chhattisgarh Special Public Security Act and awarded two years imprisonment and a fine of Rs 1,000.
They were sentenced to one year imprisonment and Rs 1000 fine under section 8(2) of the state Act, to three years prison term and a fine of Rs 1000 under section 8(3) of that Act and to five years imprisonment and fine of Rs 1000 under its Section 8(5), Dubey said.
All the three were also found guilty under provisions of Prevention of Unlawful Activities Act and sentenced up to five years jail term and a fine of Rs 1,000 each. Sanyal was also awarded 10 years imprisonment and a fine of Rs 2,000 under Section 20 of the Act.

If you got money and because of your company if thousands die then also our Indian laws do not give them life imprisonment.
If you are corrupt but you got money then also there is no punishment.
If you got money and even if weapons or bombs are found in home then also you will not get life imprisonment
But if you are poor and honest and do the simple mistake or if authorities do not like you then also you will get life imprisonment.
But Dr. Binayak Sen got knowledge , he got education , he got heart
But he was not billionaire
Is this reason Dr. Binayak Sen got life imprisonment ?

The Chhattisgarh High Court today will hear a petition for the suspension of sentence and grant of bail of Human Rights activist Dr. Binayak Sen.
He was convicted and sentenced to life imprisonment on sedition charges by the Additional District and Sessions Court at Raipur last month.
Bharatiya Janata Party (BJP) Member of Parliament Ram Jethmalani will represent Sen in Court today
Justice T P Sharma and Justice R L Jhanwar will hear the arguments of both prosecution lawyers representing Chhattisgarh government and defence counsels.
An eight-member team of European Union (EU) arrived in Raipur on Sunday to witness Sen's bail hearing.
European team watching the case will not change or influence the case or High court judge.
The European Union delegation includes representatives of Delhi based diplomatic missions from Belgium, France, Germany, Hungary, Sweden and the UK.
Today world is becoming Global village and we need to move with that.

I didn’t hear about Dr, Binayak sen on television channel, I came to know about him
Through blogs. Whatever I read about him, I thought every Indian should know about him.
Since May 15, 2007, Binayak Sen, a distinguished Indian pediatrician and a tireless human rights activist has been imprisoned in a Raipur jail in the state of Chhattisgarh, India.
He has been convicted of no crime but is being held under draconian state laws for his alleged association with the Naxalites—an outlawed Indian communist movement, deemed to be a threat to national security.
In May 2007, he was detained for allegedly violating the provisions of the Chhattisgarh Special Public Security Act 2005 (CSPSA) and the Unlawful Activities (Prevention) Act 1967
In December 2007; his bail petition was rejected by the Supreme Court of India.
Dr. Sen. is the winner of the tenth annual Jonathan Mann Award 2008 for Global Health and Human Rights, and the first winner from India and South Asia.
Dr Sen. was the recipient in 2004 of the Paul Harrison award for a lifetime of service to the rural poor.
Dr. Sen. was awarded the R.R. Keithan Gold Medal by The Indian Academy of Social Sciences (ISSA) on 31 December 2007
On 16 May 2007, Amnesty International issued a call to the Government of Chhattisgarh to "immediately release Dr. Sen. unless he is charged with a recognizable criminal offence and take urgent steps to end the harassment of the other human rights defenders in the state.
On 31 December 2007, the R.R. Keithan Gold Medal of the Indian Academy of Social Sciences was conferred on Dr. Binayak Sen. (in absentia) at a function chaired by Dr. B. N. Mungekar, Member, Planning Commission of India, and Chairperson of the Indian Academy of Social Sciences.
Dr Sen. is the National Vice-President of the People's Union for Civil Liberties (PUCL) and General Secretary of its Chhattisgarh unit.
I didn’t see anything or hear about Dr Binayak Sen, on Indian television media. I read that NDTV and BBC and radio Australia highlighted about Dr.Sen.
We hope Supreme Court of India will give the justice to Dr. Sen.

Civil rights activist Binayak Sen has been honoured with the 2011 Gwangju Prize for Human Rights, South Korea's most prestigious award for those working on peace, democracy and justice in Asia.
The award was announced on Thursday by 2011 Gwangju Prize Committee in Seoul.
The prize, which carries a sum of $50,000 is awarded each year on May 18 - on the anniversary of the May 1980 Gwangju democratic uprising to a person or organisation who has made significant contributions in the field of human rights and democracy.
