Actor Shiney Ahuja gets bail in Maid Rape Case gets freedom
The Bombay High Court has granted bail to actor Shiney Ahuja on payment of surety of Rs 50,000 to the session’s court in the rape case of his maid.
Shiney Ahuja was sentenced to seven years in jail by a Mumbai court on March 30, 2011.
High Court Judge AR Joshi while giving bail to the Actor Shiney Ahuja told him not to leave India.
Now let us see after one year or after 50 year the justice will be done.
May be before that the matter will be compromised and Ahuja will get acquitted.

Bollywood actor Shiney Ahuja has been convicted for raping his domestic help by a Mumbai court.
Shiney Ahuja had earlier been granted bail by Justice A P Deshpande of Mumbai High Court on October 1, 2009 on a surety of Rs. 50,000 with a condition that he would stay in Delhi and report to the nearest police station regularly.
In 2009 Bollywood Actor Shiney Ahujas 18-year-old maid accused him of rape, when both of them were alone at his flat.
According to her statement to police, Shiney's wife and child had gone out when the incident happened.
The maid was employed at Abuja’s home since 45 days.
But reports mentioned that the complainant (maid) had been working at Ahuja's apartment for nearly a year.
She apparently told the police that she had come for domestic work to Ahuja's flat. The actor's wife was not at home. "He took me into his bedroom, gagged and raped me
The complaint was registered at Oshiwara police station
The actor has been booked under
Section 376 (rape),
Section 339 (wrongful restraint)
And section 506 (threatening to kill the victim) of the Indian Penal Code (IPC).
The medical reports confirm that Shiney is guilty and that his DNA had been found to match the sperm found on his maid’s clothes.
Though the forensic report confirmed that the semen sample taken from maid’s body matches the star’s DNA
The trial was being conducted in-camera before the Sewri fast track court.
In-camera trial refers to a case where the court bars the media from reporting about the case as per section 327 of the CrPC, applicable in cases like rape.
Shiney Ahuja has been sentenced to seven years in prison.
From court, Ahuja was taken to jail.
The rape victim maid turned hostile in the case of Shiney.
Now Sessions Court has issued a notice to maid as to why no action should be taken for having filed a false report," the judge observed while delivering the verdict on March 30.
Sessions judge P M Chouhan pointed out seven circumstantial evidences to nail the actor in the crime that include semen stains on bed sheet and a nail injury on the actor's arm indicating that force was used on the victim.
Now Shiney Ahuja will appeal in the High court against this judgment.

Ahuja made his acting debut with Hazaaron Khwaishein Aisi, which was released in 2005.
Shiney Ahuja has acted in hit films like Gangster, Hazaron Khwaishen Aisi and Woh Lamhe.
He bagged the Kalakar award for ‘Best actor in 2008’ for Khoya Khoya Chand.

No one has expected that SRK, Shahrukh khan will challenge Shivsena a political party to whom everyone fears and tries to stay away from them and do immediately as ordered by Shiv Sena .
India is a democratic nation, so everyone has a right to say what ever he or she thinks or believes, then it may be right or wrong it does not matter until that statement does not defame someone or threaten someone.
Democracy does not mean that one can threaten any one openly and proudly through print media, electronic media not once but again and again.
In India I always say we do not have democracy, we got mob rule in India.
SRK is the owner of IPL cricket team Kolkata Knight Riders.
Recently IPL hold the auction of cricket players, and no one purchased the Pakistani cricket player.
After that SRK commented over involving Pakistani cricketers in the Indian Premier League,
After this all controversy started, as Shivsena ordered SRK to say sorry, and apologize for his comments regarding Pakistani player’s inclusion in IPL 3.
Unexpectedly something different happened and
SRK dared, shivsena by openly declaring that He has not made any mistake, he will not say sorry.
On 12th February 2010 a movie named as my name is Khan is releasing in which SRK is the main actor.
Shiv Sena has warned to SRK that if he does not say sorry, Shiv Sena will not allow the screening of movie my name is khan.
Sanjay Raut , the Shiv Sena party member said that , let SRK make this statement in Mumbai city , they said that this is not SRK speaking but the Khan is speaking , khan is speaking.
Further They said that the home of SRK is in Mumbai and not in Pakistan.
Even Shiv Sena has told multiplex not to screen or show the movie , and people have already seen the effect in Mumbai city as majority Multiplex owners removed the posters of My name is Khan and thinking that not to show the SRK movie My name is khan in their multiplex to save the multiplex from damage.

India is a poor country and 80% Indians earn daily only half American dollar, we got many problems but in India now political parties will make SRK controversy a big issue, media and everyone will spend many hours daily discussing who said what and what SRK said.
In the end result is zero,no one will get nothing only Movie will make the profits and media owners will make profits.
SRK will say sorry to shivsena or India and suddenly we will get the news that SRK and shivsena solved their problem and movie is releasing.
In the year 2004 Shiv Sena invited Pakistani Cricket Player Javed Miandad, who is the relative of Bombay blast main accused Dawood Ibrahim.
Javed Miandad’s son married the daughter of Dawood Ibrahim one of the most wanted criminal in India.
Before the year 2004 India has seen many terror attacks from Pakistani Terrorist including Kargil war.
Why Double Standards ?
Normally I try to avoid writing about this type of marketing tricks, now after this controversy what will happen ,
Suppose in Maharashtra , movie MY Name is khan , is not shown what will happen ?
No one will suffer any financial losses, as SRK is very popular in India, England and USA as well as Muslim nations
The SRK controversy has nothing to do with the movie , so do not be fooled and think that My name is Khan , movie has to do something with this controversy.
Without any reason , Shivsena is targeting the My name is Khan movie,
Shiv sena is angred regarding the comment of SRK and pakistani cricket players, about IPL cricket then it is natural that they should boycott or threaten the IPL matches and SRK owned IPL team but not the movie My name is Khan.
Why this type of controversies now and then happen in India ?
Currently In India we got many laws to stop this type of controversies ,
but reality is that those all the laws are useless and even if Shivsena members are arrested they will come out of jail in few hours and will celebrate and do the harm which they say will do it.
India need good laws, which will create the fear in the eyes and minds of criminal people.
But Indian laws are so good that in India every honest person is afraid of police and judiciary.
Last question -
Does SRK will say sorry to Shiv Sena before the 12 the February 2010 and will prove that SRK and Shiv Sena controversy was nothing but a marketing trick or SRK will fight for Freedom of speech with Shiv Sena.
Which until now in India no one has dared, even if someone dares we know in the end without any judicial result both parties become friends or forget the problem.
If this happens , other thing will happen ,

Now Shivsena has declared that they do not have any objection with movie my name is khan. And SRK commented that if Shiv Sena Chief orders him to visit his home, SRK will go their and explain him the matter.
Was it Marketing Trick to Promote My name is Khan
in this controversy, MNS benefited, Movie Benefited , only Shiv Sena did not get any benefit from this controversy.

Whatever may have happen, but our Indian Democracy is defeated once more,
Our rich people are also afraid of going to judiciary, and police department.

Someone says He do not like this part and we Indians immediately say sorry to him, because I fear he will beat me, he will do the damage to me.
If political parties want to work as censor board then what is the use of Indian censor board, don’t you think Indian censor board should be scrapped.
If I like to use word, Bombay what is bad in that, does it mean I do not love India,
When I am not ashamed to use to the laws given by the British people to Indian slaves, which I am proudly using them , that time why don’t I get the feeling that I am insulted,
Where is my freedom of speech and liberty?
Controversy is that in the movie, the word Bombay is used and some one didn’t like it so they disrupted the screening of this movie. After this it is expected that one will go to police station and launch the complaint but here happened something else, the so called person said sorry, without his any mistake.
It is reported that the film’s producer Karan Johar has apologized for referring 'Mumbai' city as 'Bombay' in the film. He further said that a disclaimer will now be carried in the beginning of the film.
After this I only know that Indian Democracy is defeated in this, I have decided not to watch this movie.
And if you love the Indian democracy and if you feel that Indian democracy is defeated in this controversy then please do not watch this movie Wake up Sid.

Pirated DVDs Buyers and Mpda provision: a deep analysis –
Reason to write this post is that I came to understand that majority Indians do not understand the seriousness of these new provisions.
Selling and buying pirated DVDs and cds is already crime and tried under Indian Penal code and Copy right act,
What is bailable offence?
In short the accused person does not stay in jail more than 24 hours, if he is able to give surety and bond amount.
Non bailable offence means an offence in which accused is kept in jail so police can investigate more normally dangerous crimes like murder are non bailable
The judicial system and courts do not work as you see in the Hindi movies.
I have not found any Hindi movie or television serial which shows court proceedings
Correctly.
The Maharashtra govt. has recently made few changes, added new provisions to
Maharashtra Prevention of Dangerous Activities of slum-lords, bootleggers,
Drug offenders and dangerous persons Act, 1981 in short this act is known as
Mpda Act. Under this act now Buyers of pirated DVDs and sellers will be tried and punished if found guilty.
To understand the seriousness we will start with an example.
If 18 year old bunty and babli are arrested by police for purchasing a pirated DVDs.
Under this new law, so what will happen, next stage is they may be send to Nashik jail
As normally accused persons arrested under Mpda act are send to Nashik Jail.
As this law prohibit bail for 3 months, bunty and babli both have to stay in jail for 3 months.
Next stage is after 3 months they will get bail and will not stay in jail but there case will start ,to finish there case it may take 1 year to 10 years.
Suppose after 2 years the honorable judge founds that bunty and babli both are innocent
And sets them free...
For just buying DVD for 80 rupees both land up in jail for 3 months, they are denied bail.
After staying in jail for 3 months does society will accept them, will they even show face to there parents.
Will they commit suicide after staying in jail for 3 months. Or will they become professional criminals?
What is reason they are not given bail, this should be bailable offence, and will the buyer run away from police and court.
Do you think buyer of pirated DVD is so rich that he will run away and stay in Europe?
Normally bail is not given to persons whose crime is dangerous and there is possibility that he will run away from law and cause more damage to society.
The buyers of DVDs are young innocent boys and girls. In jail they will come to know that if he would have used the force or cheated and got the DVD forcefully then also he would have got the bail .He will realize that it is better to rob or cheat than buy a DVD.
Surely message will go that if you want DVD go and rob the shop keepers who sell the original DVDs. If you are found by police you will get the bail, the accused person does not require to stay in jail for forcefully taking the DVD from shopkeepers.
But if you purchase DVD by paying 80 rupees or 100 rupees and police booked you under this Mpda act , surely the buyer will land up in jail for 3 months, it does not matter he is guilty or not guilty.
A person arrested under IPC provisions can obtain bail, a detainee, accused under MPDA cannot resort to bail and has to challenge the act in court As per new provisions a buyer of DVD who is booked by police under this act ,can not get bail for 3 months. He can file for bail. Only after 3 months.
For buying a DVD of 80 rupees he has to stay in jail for 3 months, after that the case will be tried and the buyer will be punished.
The correct approach would have been that, make such a law that in market there will be no pirated DVDs available.
Find the persons and punish them who are manufacturing the pirated DVDs and cds.
Law should punish the sellers; law should close down the chor bazaars which are present in every Indian city and village. Many times you will find that chor bazaar is situated behind or near the police station.
Chor bazaar means thief market.
Few questions to think?
Will it be good if Indian musicians are charged under this act for copying Hollywood music?
Will it be good if Indian movie makers, producers are charged under Mpda act for copying Hollywood movies?

Pirated DVDs Buyers and Mpda provision: a deep analysis –
Reason to write this post is that I came to understand that majority Indians do not understand the seriousness of these new provisions.
Selling and buying pirated DVDs and cds is already crime and tried under Indian Penal code and Copy right act,
What is bailable offence?
In short the accused person does not stay in jail more than 24 hours, if he is able to give surety and bond amount.
Non bailable offence means an offence in which accused is kept in jail so police can investigate more normally dangerous crimes like murder are non bailable
The judicial system and courts do not work as you see in the Hindi movies.
I have not found any Hindi movie or television serial which shows court proceedings
Correctly.
The Maharashtra govt. has recently made few changes, added new provisions to
Maharashtra Prevention of Dangerous Activities of slum-lords, bootleggers,
Drug offenders and dangerous persons Act, 1981 in short this act is known as
Mpda Act. Under this act now Buyers of pirated DVDs and sellers will be tried and punished if found guilty.
To understand the seriousness we will start with an example.
If 18 year old bunty and babli are arrested by police for purchasing a pirated DVDs.
Under this new law, so what will happen, next stage is they may be send to Nashik jail
As normally accused persons arrested under Mpda act are send to Nashik Jail.
As this law prohibit bail for 3 months, bunty and babli both have to stay in jail for 3 months.
Next stage is after 3 months they will get bail and will not stay in jail but there case will start ,to finish there case it may take 1 year to 10 years.
Suppose after 2 years the honorable judge founds that bunty and babli both are innocent
And sets them free...
For just buying DVD for 80 rupees both land up in jail for 3 months, they are denied bail.
After staying in jail for 3 months does society will accept them, will they even show face to there parents.
Will they commit suicide after staying in jail for 3 months. Or will they become professional criminals?
What is reason they are not given bail, this should be bailable offence, and will the buyer run away from police and court.
Do you think buyer of pirated DVD is so rich that he will run away and stay in Europe?
Normally bail is not given to persons whose crime is dangerous and there is possibility that he will run away from law and cause more damage to society.
The buyers of DVDs are young innocent boys and girls. In jail they will come to know that if he would have used the force or cheated and got the DVD forcefully then also he would have got the bail .He will realize that it is better to rob or cheat than buy a DVD.
Surely message will go that if you want DVD go and rob the shop keepers who sell the original DVDs. If you are found by police you will get the bail, the accused person does not require to stay in jail for forcefully taking the DVD from shopkeepers.
But if you purchase DVD by paying 80 rupees or 100 rupees and police booked you under this Mpda act , surely the buyer will land up in jail for 3 months, it does not matter he is guilty or not guilty.
A person arrested under IPC provisions can obtain bail, a detainee, accused under MPDA cannot resort to bail and has to challenge the act in court As per new provisions a buyer of DVD who is booked by police under this act ,can not get bail for 3 months. He can file for bail. Only after 3 months.
For buying a DVD of 80 rupees he has to stay in jail for 3 months, after that the case will be tried and the buyer will be punished.
The correct approach would have been that, make such a law that in market there will be no pirated DVDs available.
Find the persons and punish them who are manufacturing the pirated DVDs and cds.
Law should punish the sellers; law should close down the chor bazaars which are present in every Indian city and village. Many times you will find that chor bazaar is situated behind or near the police station.
Chor bazaar means thief market.
Few questions to think?
Will it be good if Indian musicians are charged under this act for copying Hollywood music?
Will it be good if Indian movie makers, producers are charged under Mpda act for copying Hollywood movies?
Will it be good if writers of movies are found copying other writers stories are tried under Mpda act?

The Maharashtra state government’s proposal of booking both buyers and sellers, of pirated cds and DVDs, under the stringent Maharashtra Prevention of Dangerous Activities (MPDA) Act has been Okayed passed by President Pratibha Patil.
That makes Maharashtra the first state where selling and buying pirated CDs and DVDs can land one behind bars without bail for 3 months.
Most important and dangerous provision is that, the buyer will not get bail for 3 months.
Who are the buyers? Normally buyers are young collagians, school kids, and poor persons, who can not afford to visit multiplex, nor do they afford to purchase a legal DVD which cost 500 rupees or 300 rupees because after doing hard work daily for 8 to 12 hours, then also they are not able earn to earn more than 20 rupees. 1 dollar is equal to 50 rupees.
This amendment do not seem correct, it is not required, Indian penal code has many provisions.
Just for example I will discuss one ipc section, section 323 deals with beating to someone, if you break someone’s leg, hand, this offence is bailabale and in 24 hours you are outside of the jail.
For buying a DVD you are send to jail for 3 months, a non bailable offence.
This does not seem correct.
Now suppose this youth goes to jail and stays in jail for 3 months, what will happen, will he become a real gunda or criminal, a terrorist
Normally Mpda act is used for slumlords and dangerous activities, like forcefully taking another’s land etc.

Hafta means weekly or monthly bribe to do illegal activity.

December 1 2001 ,the Honorbale high courts of Punjab and Haryana found
sidhu guilty and sentenced him to three-year imprisonment in a case of culpable homicide not amounting to murder. But sidhu is not in jail this is 2009 and still his case is pending in the
honorable supreme court of india.
we hope in his life time the judgement will come and he will go to jail.
what happens if in this years all witnesses are dead.
The Supreme Court stayed the conviction of cricketer-turned-politician Navjot Singh Sidhu in a road rage death case paving the way for him to contest the bypoll for Amritsar Lok Sabha seat.
What will happen to Indian democracy if criminals and convicts sit in the Parliament? Once again the people are assailed by doubts and uncertainty looms large and it has a highly unsettling effect.
If you are a rich perosn in india ,law is a toy for you do u think this is correct ?
i am a common man if i will just utter a word or carry a stone i am surei will end up in jail for life without lawyer and bail.as i dont have money to pay to the lawyers and for my bail.
For a common man,for mother india a criminal is a criminal then he may be arun gawli or dawood or sanjay dutt or sidhu or kasab all must be fined and punished if found guilty on time.
what is the use of food when person is on hungar strike ,when he was hungry one should give him food ,not after his death.

and people say india is shinning ,people say india is super power.

Difference Between uk prime minister and indian mp, minister hema malini.
Both have same story travel without ticket. In uk tony blair got the ticket his copassenger
help him out .
But india no one dare to ask the minister, please madam pay the fines and get the tickets .
Hema Malini travelled from Kurduwadi in Solapur to Dadar by the Siddeshwar Express
yesterday – without a ticket. She, however, managed to escape any penalty, as the
organisers had booked the tickets, but failed to give her the printed ticket?
Did they acutally got the tickets ? does anyone saw the tickets ?
The Rajya Sabha MP had travelled to Pandharpur for the inauguration of a branch of the
Sawarkar Vichar Manch on Thursday. Hema decided to take the overnight train back, as she
wanted to reach Mumbai in the morning
If this happens with a indian common man, he honestly forgets his tickets at home what
would have happend ?
Just think this happens with you and you forgot tickets ?
answer : humiliation,fine,jail ,thorowing you out of train,what will happen ?

BJP MP Jual Oram said that the identity card of an MP was treated like a railway ticket.
"Even if we enter a train without a ticket and if seats are available, the TTE can allot us the
seat against our MP Identity Card number. But an MP must keep his I-Card with him, as that
is the only proof that the person is an MP," Oram said. It wasn't known if Malini was travelling
with her identity card.
However, Chief PRO, Northern Railway, Rajeev Saxena, said that MPs travelling without a
ticket can be penalised. "Be it a railway employee or an MP, they have to inform the authority
to reserve a berth in the train," he said.
J P Aggarwal, Rajya Sabha MP and Delhi Pradesh Congress Committee president, said,
"Even for MPs, the formalities are the same as that of a common man. We just have the
privilege that we don't have to pay for our ticket. We are issued tickets with Rs 0 in the fare
column."
same incidenet happend with tony blairs wife ,In 2001, Blair's wife Cherie was forced to pay
a ten-pound fine plus a 7.90-pound fare when she was caught travelling to Luton from
London Blackfriars without a ticket.
