Part 37 – Indian Legal history – Government of India Act 1919 –

Secretary of state, Edwin S.Montagu and the viceroy of India Lord Chelmsford wrote an inquiry report regarding participation of Indians and responsible government in India, this report was published in 1918, Report on Indian constitutional Reform.
This report served as the basis for the creation of the legislation.



The government of India Act 1919 was passed by the British Parliament
To increase participation of the Indians in the government of India.
The Act embodied the reforms recommended in the report of the Secretary of State for India, Edwin Montagu, and the Viceroy, Lord Chelmsford.
The Act covered ten years, from 1919 to 1929.
The act was enacted for ten years from 1919 to 1929.

The Act provided a dual form of government (a "dyarchy") for provinces.

Matters of administration were first divided between the centre and the provinces and then the provincial subjects were further bifurcated into transferred and reserved subjects.

The transferred subjects were to be administered by the governor with the help of ministers responsible to the legislative council composed mainly of elected members.

The Transferred subjects are:

(1) Education, (2) Libraries, (3) Museums, (4) Local Self-Government, (5) Medical Relief, (6) Public Health and Sanitation, (7) Agriculture, (8) Cooperative Societies, (9) Public Works, (10) Veterinary, (11) Fisheries, (12) Excise, (13) Industries, (14) Weights and Measure, (15) Public Entertainment, (16) Religion and Charitable Endowments, etc.


The reserved subjects were to remain the responsibility of the governor and his executive council which was not responsible to the legislature.
Governor got the power to override ministers and executive council.

The Reserved Subjects are:

(1) Land Revenue, (2) Famine Relief, (3) Justice, (4) Police, (5) Pensions, (6) Criminal Tribes, (7) Printing Presses, (8) Irrigation and Waterways, (9) Mines, (10) Factories, (11) Electricity, (12) Labour Welfare and Industrial Disputes, (13) Motor Vehicles, (14) Minor Ports, etc.

The effect of government of India Act 1919 –
(1) To introduce the bicameral or two chamber system in the Indian legislative council
(2) To increase the size of the provincial legislative council , to increase number of the elected members in each
(3) To substitute direct for indirect election
(4) To enlarge the electorate

This act applied the principal of communal representation to Muslims, Sikhs, Anglo-Indians, and Indian Christians etc.

The Indian legislature council was to be called as the Indian legislature.

The Indian legislature consisted of governor general and two chambers, the council of state and the legislative assembly.
The council of state consisted of 60 members nominated or elected under the rules, of whom not more than twenty were to be official members.
Thus council got 33 elected members and 27 nominated by the governor general of whom not more than 20 could of officials.

The legislative assembly consisted of 143 members.
The number of non elected members was 40 of whom 25 were official members and 15 non officials.
The number of elected member was 103.
To pass a law, including financial bills consent of both houses was required.

The power of both houses were same exception was power to vote supply was allowed only to the Legislative assembly.

The duration of council was fixed at 5 and of the assembly at three years.
The governor general got the power to dissolve either house or to extend its existence if necessary.

The members were elected by a process of direct election, in hope that the people will choose people to represent them.

Thus Hindus started to elect Hindus and Muslims elected Muslims and also there was communal representation.

The act of 1919 did not introduce federalism in India.
Governor General in council got the power and authority to decide whether a particular subject was central or provincial subject.

Telangana - Srikrishna panel submits report to Government –

Justice B N Srikrishna Committee, 5 member committee on Telangana issue submitted its report to Union Home Minister P Chidambaram.

The five-member committee, headed by former Supreme Court chief justice BN Srikrishna, also included former union home secretary Vinod Duggal, IIT Delhi professor Ravindar Kaur, International Food Policy Research Institute Senior Research Fellow at New Delhi Office Dr Abusaleh Sharif and National Law University Vice-Chancellor, Jodhpur, Prof (Dr) Ranbir Singh.



The panel has submitted a two-volume report on creation of Telangana state with different options, giving advantages and disadvantages of each option.

The committee was constituted on February 3 and visited Andhra Pradesh 28 times during the past 11 months. It also heard all political parties in the state and received over 1.25 lakh representations from different stakeholders.

Terms of reference of Srikrishna Committee included:

(1) To examine the situation in the State of Andhra Pradesh with reference to the demand for a separate State of Telangana as well as the demand for maintaining the present status of a united Andhra Pradesh.

(2) To review the developments in the State since its formation and their impact on the progress and development of the different regions of the State.

(3) To examine the impact of the recent developments in the State on the different sections of the people such as women, children, students, minorities, other backward classes, scheduled castes and scheduled tribes.

(4) To consult all sections of the people, especially the political parties, and other organisations and then find the proper solutions which will benefit everyone in state and recommend a plan of action


The report prepared by Srikrishna panel on Telangna will be made public on
January 6, 2011.

Creation of Telangna is necessary important stage for India.
Thus this will open path for creating more small states in India.

Maharashtra government asked to Ramanand Tiwari and Subhas Lalla to resign over their involvement in the Adarsh Society scam.

Tiwari was urban development secretary when the Adarsh file was being processed
Tiwari's son, Omkar is member in Adarsh society



Subhas Lalla was secretary to the chief minister.
Lalla's mother Susheela Shaligram and daughter Sumeela Sethi.are members in Adarsh society.

What would have happen if both have resigned after the demand from government?
The duo's resignation has to be forwarded to the state governor for his acceptance.

But both Ramanand Tiwari and Subhas Lalla has denied and said that they will not resign from their post, directly challenging the government of Maharashtra.

Information commissioner Ramanand Tiwari and human rights commission member Subhash Lalla both refused to quit, saying they were not involved in the Adarsh Housing Society scam.

Now government has to start the process of dismissal against them.

To remove Ramanand Tiwari the state government will have to knock on the doors of Raj Bhavan

To remove Subhash Lalla state government will have to approach the President of India.

Both the duo know that Government has done nothing in 2G spectrum scam so they must have become fearless and also our Indian government moves so slow that they will retire from their post but our government will not give their decision of sacking them , firing them from their job.

If congress government want action on corrupt babus from heart then state and central government should sack and fire both of them by working hard in a week time.

But do you think our government can work for the India?
Will they terminate the services of babus?

We need to amend our Indian laws and remove all type of protections these babus and
politicians enjoy.

Former IAS officer Subhash Lalla, whose mother and daughter own flats in the scam-hit Adarsh Housing Society in south Mumbai resigned as a member of Maharashtra State Human Rights Commission.

Subhash Lalla met Governor K Sankaranarayanan at Raj Bhavan this morning and submitted his resignation.

"The Governor has accepted Subhash Lalla's resignation

Justice equals to Life Imprisonment for corruption.

Katie Leonard, a 23-year-old American woman student and her classmate Gourab Sarangi of Sambalpur, doing PhD in Physics in the USA, entered the 12th century to have a glimpse of the presiding deities.



As the woman student was dressed in a traditional salwar-kameez and covered her head, she was not recognised as a foreigner at the high-security Singhadwar.

After a glimpse of the 'parswadevatas', they entered the sanctom sanctorum for a darshan of the presiding deities - Lord Jagannath, Balabhadra and Devi Subhadra - where they
were spotted by the priests.

The rituals at the temple came to a standstill after the priests and temple police took the two to the Sinhadwar police station for questioning.

After interrogation they would be handed over to the temple administration which would, in all probability, let them off with a nominal fine for violating temple rules, police sources said.

Temple rituals were affected as the deities were given a 'Mahasnan', a ritual for purification as non-Hindus are not allowed entry into the temple, Panda said.

- Public Accounts Committee

The full form of PAC is Public Accounts Committee.

Indian parliament has limited time.

To check and scrutinize Annual Accounts and the Audit Reports specialized knowledge is required.

Therefore the Parliament and the State Legislatures have, for this purpose, constituted specialized Committees like the Public Accounts Committee (PAC)
and the Committee on Public Undertakings (COPU), to which these audit Reports and Annual Accounts automatically stand referred.


The Public Accounts Committee satisfies itself:-

1.That the moneys (shown in the accounts) were disbursed legally on the service or purpose to which they were applied.

2.That the expenditure was authorized

3.That re-appropriation (i.e. distribution of funds as between sub-objectives) were made in accordance with rules.

It is also the duty of the PAC to examine the statement of accounts of autonomous and semi-autonomous bodies, the audit of which is conducted by the Comptroller & Auditor General either under the directions of the President or by a Statute of Parliament.

The Committee on Public Undertakings exercises the same financial control on the public sector undertakings as the Public Accounts Committee exercises over the functioning of the Government Departments.

The functions of the PAC Committee are:-

1.To examine the reports and accounts of public undertakings.

2.To examine the reports of the Comptroller & Auditor General on public undertakings.

3.To examine the efficiency of public undertakings and to see whether they are being managed in accordance with sound business principles and prudent commercial practices.

The examination of public enterprises by the Committee takes the form of comprehensive appraisal or evaluation of performance of the undertaking.

It involves a thorough examination, including evaluation of the policies, programmes and financial working of the undertaking.

The Committees do not generally question the stated policies of the Government as they usually would have the approval of Parliament (in which the Government would be enjoying a majority).

But they can and often do comment on the implementation of the policies, e.g. losses, wasteful expenditure and financial irregularities.

When these are the result of negligence, the Committee calls upon the Ministry / Department concerned to detail the action, disciplinary or otherwise, it had taken to prevent its recurrence.

In such cases the Committee also records its opinion either disapproving the action of Government of passing strictures against the extravagance or lack of proper control by the concerned Ministry / Department.

The objective of the Financial Committees, in doing so, is not to focus only on the individual irregularity, but on the defects in the system which led to such irregularity, but on the defects in the system which led to such irregularities and the need for correction of such systems and procedures.

The Comptroller & Auditor General of India plays a key role in the functioning of the financial committees of Parliament and the State Legislatures.

He has come to be recognized as a 'friend, philosopher and guide' of the Committee. His Reports generally form the basis of the Committees' working, although they are not precluded from examining issues not brought out in his Reports.

He assists the Committees by furnishing Memorandum of Important Points (MIP) on the cases selected for detailed examination, which helps in the framing of questionnaires for oral evidence of witnesses summoned by the Committees.

During examination of witnesses, he helps the Committees in ascertaining the correct facts and provides additional information relevant to the examination.

At times, he intervenes on behalf of the Committees to clarify and elucidate evidence taken from the witnesses.

He scrutinizes the notes which the Ministries submit to the Committees and helps the Committees to check the correctness submit to the Committees and helps the Committees to check the correctness of facts and figures in their draft reports.

The Financial Committees present their Report to the Parliament/ State Legislature with their observations and recommendations.

The various Ministries / Department of the Government are required to inform the Committees of the action taken by them on the recommendations of the Committees (which are generally accepted) and the Committees present Action Taken Reports to Parliament / Legislature.

In respect of those cases in Audit Reports, which could not be discussed in detail by the Committees, written answers are obtained from the Department / Ministry concerned and are sometimes incorporated in the Reports presented to the Parliament / State Legislature. This ensures that the audit Reports are not taken lightly by the Government, even if the entire report is not deliberated upon by the Committee.

Till 1981, there was no practice of ascertaining the action taken by the Ministries/Departments on the Audit paragraphs not selected by the Committee for detailed examination.

However, with a view to ensuring enforcement of accountability of the executive in respect of all the issues dealt with in various Audit Reports, the Committee on Public Accounts decided in 1982 that the Audit Reports for the year 1980-81 be referred to the Ministries/Departments concerned for furnishing notes, duly vetted by Audit, showing remedial/corrective Action Taken on all the paragraphs contained therein.

The system has further been streamlined to review the remedial/corrective action taken notes furnished by Government on the non-selected Audit Paragraphs.

At their sitting held on 8.8.2000, the Committee decided that the remedial/correction Action Taken Notes received from Government are sent to Office of C&AG for categorization like

(a) Accepted

(b) Partially accepted

(c) Not accepted

And then circulated these to the Members of the Committee.
Based on the categorization, the Committee may select Audit Paragraphs for detailed examination.

The Committee on Public Accounts was first set up in 1921 in the wake of the Montague-Chelmsford Reforms.

The Finance Member of the Executive Council used to be the Chairman of the Committee.
The Secretariat assistance to the Committee was rendered by the then Finance Department (now the Ministry of Finance).

This position continued right up to 1949. During the days of the Interim Government, the then Finance Minister acted as the Chairman of the Committee, and later on, after the attainment of Independence in August, 1947, the Finance Minister became the Chairman.

This naturally restricted the free expression of views and criticism of the Executive.

The Committee on Public Accounts underwent a radical change with the coming into force of the Constitution of India on 26 January, 1950, when the Committee became a Parliamentary Committee functioning under the control of the Speaker with a non-official Chairman appointed by the Speaker from among the Members of Lok Sabha elected to the Committee.

The Minister of Finance ceased to be a Member of the Committee vide Rule 309(i) of the Rules of Procedure and Conduct of Business in Lok Sabha.

The Public Accounts Committee is now constituted every year under Rule 308 of the Rules of Procedure and Conduct of Business in Lok Sabha.

The Public Accounts Committee consists of not more than 22 members comprising of 15 members elected by Lok Sabha every year from amongst its members according to the principle of proportional representation by means of single transferable vote and not more than 7 members of Rajya Sabha elected by that House in like manner.

Prior to the year 1954-55, the Committee consisted of 15 members who were elected by Lok Sabha from amongst its Members.

But with effect from the year 1954-55, 7 members from the Rajya Sabha are also being associated with the Committee.
Till 1966-67, a senior member of the ruling party used to be appointed by the Speaker as Chairman of the Committee.

In 1967, however, for the first time, a member from the Opposition in Lok Sabha was appointed as the Chairman of the Committee by the Speaker.

This practice continues till date. The term of office of members of the Committee does not exceed one year at a time.

A Minister is not elected a member of the Committee, and if a member, after his election to the Committee is appointed a Minister, he ceases to be a member of the Committee from the date of such appointment.

The Chairman of the Committee is appointed by the Speaker from amongst the members of the Committee from Lok Sabha.

Who was the first chairman of the Public Accounts Committee?
The first chairman was Mr. W. M. Hailey, year was 1921.

Currently BJP leader Murli Manohar Joshi is the chairman of PAC that is public accounts committee.


Since the Committee became a Parliamentary Committee under the control of the Speaker from January, 1950, it has presented 1337 Reports till 30th April, 2006.

Pune Municipal Corporation removed the statue of Dadoji Konddev from Lal Mahal and after this BJP and Shivsena started protest against this.

The statue was part of a three statue installation at the historic Lal Mahal.
The other two statues are of king Shivaji and his mother Jijamata.

The demand to demolish the statue was made by Maratha organizations in the city who say that Dadoji Konddev was not the Guru of king Shivaji.
King Shivajis mother Jijabai taught him everything.

The Shiv sena and BJP had opposed the demolition of the statue



MNS also opposed the demolition of the statue.

Shiv sena and BJP both opposed this, after the removal of statue both started violent protest in Pune Municipal Corporation and later it began all party fight and everything was broken in Pune Municipal Corporation.

Regarding this episode MNS chief Raj Thackeray said that Congress-NCP had used the controversy over role of Dadoji Konddev in Chhatrapati Shivaji's life to divert attention from more important issues like the price rise.

What was the harm if Shahaji's statue was installed along with Dadoji and Shivaji?"

In my own school days I learned that Dadoji Konddev was his Guru.

Does it mean my school taught me wrong history?

The problem with our history is that no Indian knows the true history of India; political parties keep changing the history as per their own views and to spread hatred among the caste and religions.


Now time has come forget what happened before 1950 and talk about history from1950 to 2010, what happened in this period?
People even do not know about history of India, china and Pakistan war,
Do not know about law commission.

These political parties did not learned a single lesson from King Shivaji, he even gave land for the burial of his enemies with full respect
Here what you are doing,
Fighting in Pune Municipal Corporation and damaging government property, making losses and wastage of tax payer’s money.

The money should be collected from them and they should be given imprisonment of 1 month for damaging government property.

Political parties should file the cases in the court of law if do not like the shifting of statue from Lal Mahal,

The statue has historical significance, importance no need to remove it, prove it that Dadoji was not his Guru and make the changes in the history
There is no need to remove the statue.

I tried to find the proof regarding Dadoji kondev which proves that he was not the guru of king shivaji.

Another problem is no media channel TV is asking the historians what their take is, or may be historians are afraid to talk because of fear of beating.

The National Convention of Private Unaided Schools Associations in a resolution passed at a conference said that the Right to Education Act should not be applicable to unaided schools in the country.

They demanded bringing an amendment to the Right to Education Act to exempt them from the law to "ensure their autonomy".




The conference also passed another resolution stating that they should be exempted from disclosure of information under RTI and that government has no role in the inspection and audit of schools which do not get any aid from the government.

"It was unanimously resolved in the convention that the provisions of Right to Information Act are not applicable on the unaided private schools and, therefore, the government departments should not entertain any applications made under the Act," said a release issued by the organization.

The organization also demanded that taxes like property tax, water and electricity charges should be levied at highly concessional rates and not on commercial rates as private schools are run on "no profit no loss basis".

Raipur Additional District and Sessions Judge B P Verma found Civil rights activist Binayak Sen, Naxal ideologue Narayan Sanyal and Kolkata businessman Piyush Guha guilty under provisions of section 124 IPC (sedition), 120 B IPC (conspiracy) and Chhattisgarh Special Public Security Act



Binayak, a PUCL activist, was arrested on May 14, 2007 from Bilaspur and was in jail for two years before being granted bail by the Supreme Court in May last year.

Dr.Sen had been accused by the prosecution of carrying messages and letters from Sanyal to the underground Maoists.

All the three were sentenced to life imprisonment under sections 124A and 120(B) of IPC.

The three were also found guilty under Section 8(1) of Chhattisgarh Special Public Security Act and awarded two years imprisonment and a fine of Rs 1,000.

They were sentenced to one year imprisonment and Rs 1000 fine under section 8(2) of the state Act, to three years prison term and a fine of Rs 1000 under section 8(3) of that Act and to five years imprisonment and fine of Rs 1000 under its Section 8(5), Dubey said.

All the three were also found guilty under provisions of Prevention of Unlawful Activities Act and sentenced up to five years jail term and a fine of Rs 1,000 each. Sanyal was also awarded 10 years imprisonment and a fine of Rs 2,000 under Section 20 of the Act.

The Chhattisgarh High Court today will hear a petition for the suspension of sentence and grant of bail of Human Rights activist Dr. Binayak Sen.
He was convicted and sentenced to life imprisonment on sedition charges by the Additional District and Sessions Court at Raipur last month.

Bharatiya Janata Party (BJP) Member of Parliament Ram Jethmalani will represent Sen in Court today

Justice T P Sharma and Justice R L Jhanwar will hear the arguments of both prosecution lawyers representing Chhattisgarh government and defence counsels.

An eight-member team of European Union (EU) arrived in Raipur on Sunday to witness Sen's bail hearing.

European team watching the case will not change or influence the case or High court judge.
The European Union delegation includes representatives of Delhi based diplomatic missions from Belgium, France, Germany, Hungary, Sweden and the UK.

Corruption Common wealth games, CWG - CBI raids Suresh Kalmadi after 2 months

The Central Bureau of Investigation (CBI) on Friday raided the residences of Commonwealth Games Organizing Committee chief Suresh Kalmadi and his personal secretary Manoj Bhure in New Delhi and in Pune in connection with alleged irregularities in the conduct of the Games.



The raids began at about 7 a.m. this morning when ten CBI sleuths simultaneously entered both the premises.

A team of CBI official conducted raids at his residence in New Delhi for almost eight hours and seized several documents, two laptops and some central processing units.

The CBI also raided at Kalmadi's residence in central Mumbai.

CBI officials also raided his residences and offices in Pune along with his brother's house in Mumbai. The investigating agency is also questioning his personal secretaries Manoj Bhore, Vinod Surve and Shekhar.

The CBI also raided the residence of Kalmadi's personal secretary PS Manoj Bhore in Pune.

Few days back CBI has requested the congress government to remove Kalmadi and his aide Lalit Bhanot from the CWG Organizing Committee.

CWG Scam – Court grants bail to accused Sanjay Mahendroo and TS Darbari –

The Court had granted bail to TS Darbari after the CBI failed to file the chargesheet against him for alleged misappropriations in the Queen Baton's relay in London in 2009.

Darbari got the bail as CBI prosecutor informed the court that the agency cannot file the chargesheet within the stipulated 60 days prescribed under the CrPC since investigations have not been completed.

Another accused Sanjay Mahendroo he also got bail from Delhi court in the case of Queen Baton's Relay in London in 2009.

3rd accused is Jayachandran if CBI does not file chargesheet before January 20 then he will also get the bail and he will be out of jail.

The accused are facing charges of causing losses to the exchequer in award of contract to the tune of Rs. 1.55 crore with regard to the Queen Baton's Relay on October 29, 2009 in London

CBI has arrested the head of a private firm, Binu Nanu, Director GL Events – Meroform which had bagged over Rs. 150 crore contracts from Commonwealth Games Organising Committee for overlays works.

After arrest he was remanded to 4 days police custody.

The CBI had on January 12 searched office and residence premises of Nanu
Nanu's wife Roopana is also one of his associate in the business.

Overlays works included supply of tents, marquees, prefabricated units, portable toilets, containers, security fences, furniture, public display LED boards, floor finishes, material handling equipment, gensets, cabling, UPS, lighting, air-conditioners, civil construction, athletic exercise equipment and grandstands.

In 1906, Lord Morley, the Secretary of State for Indian Affairs, announced in the British parliament that his government wanted to introduce new reforms for India, in which the Indian locals were to be given more powers in legislative affairs.



George Nathaniel Curzon was the Viceroy of India and Foreign Secretary.
In January 1899 he was appointed Viceroy of India.
The province of Bengal had an area of 189,000 miles2. and a population more than 80 million , area and population both were more compared to a France.
in August 1904 he became the Governor general of India.
Partitioning Bengal was first considered in 1903
The Partition of Bengal in 1905 was made on October 16 by then Viceroy of India, Lord Curzon.
Bengal was larger than France and larger in population compared to France.
But upper caste Hindus as well as rich Muslim people of Bengal did not like this idea and they started to oppose the partition.
Partition means reduction in their powers over local people and area.
Remember Mahabharata , Kourava did not give a single village to pandava which would have solved the problem.

A major famine coincided with Curzon's time as viceroy in which 6.1 to 9 million people died.


East Bengal got more Muslim population and West Bengal got the more Hindu population.
Indian National congress started to oppose the division of Bengal.
Indian population was uneducated that time and now also situation is same.

I am not writing on how the area was divided, today it is not important.

Due to violent protests the two parts of Bengal were reunited in 1911.
After this the Era of division based on the language started in India which people call it as a linguistic division.


The Indian Councils Acts of 1909, also known as the Morley Minto reforms by its provision, enlarged the size and their functions of the legislatures both at the center and Provinces

The following were the main features of the Act of 1909:

1.The number of the members of the Legislative Council at the Center was increased from 16 to 60. The Legislature was thus consisted of 69 members, of which 37 were to be officials while the remaining 32 non-officials.

2.The Morley Minto Reforms introduced an electoral policy for the elected members.

3.The number of the members of the Provincial Legislatives was also increased. It was fixed as 50 in the provinces of Bengal, Madras and Bombay, and for the rest of the provinces it was 30.

4.Right of separate electorate was given to the Muslims, which increased the gap between Hindu and Muslim population

5.The system of election led by the Acts of 1909 was very indirect. The people elected the members of the local bodies, which elected members of the electoral college, which in turn elected the members of the provincial Legislatures.

6.The members of the provincial legislature finally elected the members of the Central Legislature.

7.In this type of election process again for the name sake there was a voting system and people did not get any political knowledge or understanding of government working. Very skillfully rich and educated class kept the uneducated class away from all this.

8.The Secretary of State for India was empowered to increase the number of the Executive Councils of Madras and Bombay from two to four.

9.The Governor General was empowered to nominate one Indian member to his Executive Council.

10.Two Indians were nominated to the Council of the Secretary of State for Indian Affairs.

The Delhi Durbar was held in December 1911 to commemorate the coronation of King George V and Queen Mary as Emperor and Empress of India.
The necklace was presented to Queen Mary by the Maharani of Patiala

On December 15, 1911 King George V laid the foundation stones for the new capital city of New Delhi.

After the Minto Morlay reforms participation of Indians increased and as well as degradation of political process started and corruption also increased.

Once upon a time one of the Indian political leader visited America.
When he landed on American airport, the security thoroughly checked him and his baggage
Just treated him like a simple common traveler, a citizen. No special treatment as VIP or a politician

Indian politician became very angree and upset, he shouted and he called to American embassy and called Press and informed everyone that Hindu culture is violated, India is insulted.


He made lot of drama as the politicians in India consider themselves as the Kings of India and common Indian citizens are their slaves.

After through check up the politician was allowed to go to his hotel in America.

Then next day Indian Politician visited the American counter part they start to discuss political problems in India and Indian poverty with each other, they both enjoyed tea.

Then suddenly Indian politician stood and went to the window, he saw the beautiful flyover and playground.

While watching the beauty he asked the American politician, how did he manage to build such a beautiful tall bungalow?

American politician asked him, did you see the flyover and playground,
Indian politician said that, Yes I see them they are marvelous, wonderful.
Then American politician said you know I got 10% commission, kickback in that project.

Then Indian politician came back to India, but he did not forget the beauty of American politician’s bungalow.
As an Indian he was quick learner and a copy master.

After a year He invited American Politician to India.
American politician landed on a Indian Airport, Indian custom officers, airport authorities started to check them, but poor guys as soon Indian Politician knew this ,
He immediately fired few of them and transferred others from their job.
Thus without any checkup American politicians landed in India.


Then American politician directly came to meet the Indian politician, they enjoyed lunch and while talking American politician asked the Indian Politician why he did not allow the Indian airport customs officers to check their luggage?

Indian Politician said that they are his dogs and dogs should stay in their limit.
Told him politician is the king in India.
Today if they check you, tomorrow they will check his bags and then it will become difficult for him to send black money to foreign banks or to travel with escorts to foreign lands or invite escorts from foreign lands to India.
And both smiled

American politician said in next birth he wishes to be born as a politician in India.
He said American Supreme Court and constitution is perfect so it’s impossible in America to treat American citizens as dogs and slaves.

While the talk was going on American politician saw that the Indian politicians dress was foreign, his car was foreign, and his children were studying in America.
Everything in home was a foreign and represented No.1 brand around the world.

American politician was confused and did not understand how a politician of poor nation can afford this.

Then American politician asked Indian politician, how you managed to earn so much money and a beautiful bungalow which is hundred times better than any American politicians home

Indian politician became happy, he felt proud. He went to the window, asked the American politician come to the window.

Then he said do you see the flyover and playground,
American politician said no he did not see any flyover or playground
He said I can see only some construction is going on.

Then Indian politician said that’s a flyover and the area below the flyover is a playground
And he got the kickback and bribe of 100%

American politician became afraid and said in this case very soon Indian politician will go to jail.

Indian politician answered don’t worry my friend, here in India we make the law and we are the controller and kings of the departments who check the implementation of laws.
So we are the kings in India, how can a police officer arrest himself for doing corruption.

So there is no need to worry about the flyover and ground as Indian slave citizens are busy discussing and counting and fighting on caste and religion.

Then American politician went back to USA while preying to Santa that please give him next birth in India as a politician.

It has been reported that the corruption amount is more than 100 crore Indian rupees.

One of the major problem in India regarding corruption is that one has to take the permission from the government which itself is corrupt.
If anyone want to file corruption charges and case against government special employees one has to apply and get permission.

So what happened in the national games corruption?

Bhola Nath Singh of Jharkhand State Wrestling Association has complained about the alleged irregularities

Reports say that till March 2010, Rs.800 crore has been spent on infrastructure and purchase of equipment.

Six times the games were postpones and last 4 years the work is going on, I do not know how much work is completed,
This is the same story like Common wealth games corruption.

There are allegations that the office bearers of the National Games Organizing Committee (NGOC) received kickbacks from the suppliers of games equipment.

A special audit report prepared by the state Principal Accountant General in November 2009 found that the state exchequer had suffered a loss of many crores as the purchases were made from the highest bidders.

On September 27, Bhola Nath had filed a complaint with IG (vigilance) alleging purchase of sports equipment without floating tenders, purchase of equipment much in excess of actual requirement and at prices higher than market prices, and several other financial irregularities.

Bhola Nath had moved Jharkhand High Court against the NGOC office-bearers alleging corrupt practices.

On September 9, the court disposed of his petition observing that he could file an FIR with the vigilance if he had sufficient proof.

In his complaint, Bhola Nath made several specific allegations:

1.No tenders were invited for the Rs 11 crore spent on putting up high mast lights at Birsa Munda astro turf stadium at Morabadi and another Rs 1 crore spent on furnishing a VVIP guest house and lounge

2.200 dozen tennis balls had been bought for not more than 100 tennis players (in Wimbledon, 30 dozen tennis balls are purchased annually for 125 set matches played by 128 players)

3.Electronic score boards were bought from a single supplier at Rs 4.50 lakh for handball, kabaddi and kho kho, at Rs 6.50 lakh for taekwondo and at Rs 8.50 lakh for judo

4.Then sports director P.C. Mishra withdrew Rs 179.15 lakh for personal use, while lakhs of rupees were drawn as advance in the name of one S. Tirkey, a contract worker at NGOC office

5.There were three bids for badminton—Chadha Sports quoted Rs.236.09 lakh, Shiv Naresh Sports Rs.222.16 lakh and Khalsa Gymnastic Rs.110.09 lakh. The purchase order was given to Shiv Naresh Sports. Khalsa bid is lowest. Khalsa forgot this is corrupt nation think did not pay bribes.

6.Sixty-one imported equipment were purchased at an extra cost of Rs.724.91 lakh. Shiv Naresh Sports, which had quoted Rs.155.86 lakh, was the lowest bidder. But the order was given to Gem International at Rs.880.77 lakh without any reason.

7.The NGOC had awarded a tender of Rs.258.81 lakh to Celebrity Management Pvt Ltd of Kolkata to organise 33 cultural programmes and a cheque for Rs.78.54 lakh was issued as mobilisation advance. Later, when the NGOC decided to have only six cultural programmes, no reduction was made in the fee.

8.NGOC paid Rs.15.51 crore as mobilisation advance to 12 parties between November 2008 and January 2009, openly violating Central Vigilance Commission guidelines.

9.The Principal Accountant General report forced the state government to direct the vigilance to probe the alleged irregularities.

10.A five-member team led by then sports minister Sudesh Mahto visited Australia, Malaysia and Singapore in May 2005 under the pretext of incorporating international facilities in the sports complex.” Minister Sudesh Mahto even took his private secretary on a foreign trip

The state Vigilance Bureau has filed first information reports or FIRs against president of Jharkhand Olympic Association (JOA), RK Anand, former lawyer and two other JOA officials alleging financial irregularities in the purchase of sports equipment for the 34th National Games in the state.
One FIR has also been filed against a senior official from the state sports department.

Jharkhand’s Inspector General, Vigilance, MV Rao said, “We have lodged FIRs against JOA president RK Anand, secretary general SM Hashmi, treasurer Madhukant Pathak and former director, sports department, PC Mishra.”

Advocate R.K. Anand was found guilty by the Supreme Court of contempt of court and influencing witnesses in July last year.

Six times games were postponed and now it is said that games will be held in the month of February 2011.
Original date for the games was February 2007.

According to the CAG, the catering contract was allotted to the Delhi-based Gazal caterers, violating bidding norms, and incurring a loss of Rs 2.8 crores.

CAG also found that Event management company Wizcraft, has already pocketed Rs 1.73 crores as a mobilisation advance, despite the company being blacklisted by the National games Organizing Committee.

A company which won the travel contract was allegedly paid an extra Rs 3.47 crore rupees for the purchase of sports equipment.

Excess payments of over Rs 11 crores have been detected by the CAG.
Whistles available for Rs 40 each - were purchased for Rs 450 a piece.

Christmas has been banned by the Red Cross from its 430 fund-raising shops.

Staff has been ordered to take down decorations and to remove any other signs of the Christian festival because they could offend Muslims.



Christine Banks, a volunteer at a Red Cross shop in New Romney, Kent, said:
‘We put up a nativity scene in the window and were told to take it out.
It seems we can’t have anything that means Christmas.
We’re allowed to have some tinsel but that’s it.

‘When we send cards they have to say season’s greetings or best wishes.
They must not be linked directly to Christmas.

‘When we asked we were told it is because we must not upset Moslems.’

Mrs. Banks added: ‘We have been instructed that we can’t say anything about Christmas and we certainly can’t have a Christmas tree.

Same thing happened in the year 2002 also.
In 2002, Red Cross offices in Britain were ordered to take down decorations and to remove any other signs of the Christian festival because they could offend Muslims.

Yesterday, we started getting some comments on our Facebook page from people angry with us for ‘banning Christmas’, which we haven’t, and the story now seems to be spreading on some American websites.

It turns out that these people have stumbled across an article that appeared in the Daily Mail in 2002 and now forms part of the paper’s online archive. Unfortunately, the article isn’t dated on the Mail’s site, which had led some people to believe this was a current news story – although references in it to Sangatte, the Calais refugee camp that closed in 2002, do serve to date it. We denied the gist of the piece strongly at the time.

Christmas is a major UK holiday and time of celebration, which is shared by people of all faiths and those of no faith. Many of our shops and offices are decked out in festive decorations around this time of year – we also sell a range of Christmas cards and gifts in our shops, both high street and online.

It’s true that you won’t find explicitly religious items or displays, relating to any faith, in any of our shops, at Christmas or any other time. But this certainly doesn’t amount to a ban on us celebrating or mentioning Christmas, or any other holiday. And it’s absolutely nothing to do with “offending non-Christians” or to serve any other sort of politically correct agenda.

The point is that the Red Cross is not a political or religious organisation. This neutrality is one of our fundamental principles and governs everything we do in the whole Red Cross and Red Crescent Movement. It means that we can reach and help people in need, whoever and wherever they are. Often we provide help in countries that other organizations cannot or will not work in.

We cross front lines in times of war to help conflict victims and visit prisoners of war on both sides. We can only do this life-saving work because we are understood to be a completely neutral, independent organisation. Put simply, our neutrality saves lives.

We can’t let people in need down by compromising our neutrality. That is why we do not align ourselves with any particular political cause or religious creed anywhere in the world. And that’s why we don’t have any items of a religious nature in our shops.

A nativity scene in a shop in Kent might seem like it has nothing to do with our sensitive, precarious work in a war zone in Africa or the Middle East. But in a world where information travels quickly and pervasively – a world where an eight-year-old news story is still raising questions with our supporters – we have to make sure we act consistently across the board with regard to our neutrality.
